PERSAUD, BIAGGI, KRUEGER -- read twice and ordered printed, and when printed to be committed to the Committee on Agricul- ture -- recommitted to the Committee on Agriculture in accordance with Senate Rule 6, sec. 8 -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to amend the agriculture and markets law, in relation to requir- ing the department of agriculture and markets to maintain a publicly available database of the results of its graded inspections on its website The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 500 of the agriculture and markets law is amended 2 by adding three new subdivisions 6, 7 and 8 to read as follows: 3 6. The department shall maintain a publicly available database of the 4 results of its graded inspections that shall include the retail food 5 store's name, address, date of inspection, grade and a list of any 6 violations cited within ninety days of a graded inspection. The depart- 7 ment shall update the database every ninety days. The department shall 8 make the inspection database available on their website, in a conspicu- 9 ous location, including on any navigation or drop-down menu. 10 7. The department shall provide on their website information as to 11 where a customer may file a consumer report, which shall be placed in a 12 conspicuous location, including on any navigation or drop-down menu. If 13 a consumer report is filed with the department regarding a retail food 14 store, the graded inspection report provided to such retail food store 15 shall note that the store was reported by a consumer. The consumer 16 report and any other identifiable information of the consumer shall not 17 be included within the inspection report. The department shall facilitate and coordinate the planning and 2 implementation of an awareness and educational program to inform the 3 general public on the standards retail food stores shall meet and how 4 consumers may report retail food stores with poor sanitary conditions. 5 Such program shall include grading inspection posting requirements, the 6 differences of sanitation between the inspection grades, and how to 7 report a retail food store to the department. Such program shall promote 8 educational and informational materials created, through available 9 means, such as media advertising, billboards, printed literature, social 10 media and the department's official website. 11 § 2. This act shall take effect immediately.
