        Introduced  by  Sens.  MAYER,  KENNEDY,  MYRIE, RAMOS, SEPULVEDA -- read
          twice and ordered printed, and when printed to  be  committed  to  the
          Committee on Housing, Construction and Community Development

        AN  ACT  to  amend  the  executive law, in relation to standards for the
          erection of tents or membrane structures

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section 1. Section 378 of the executive law is amended by adding a new
     2  subdivision 20 to read as follows:
     3    20. Notwithstanding any other law, regulation or code to the contrary,
     4  standards  for the erection of tents or membrane structures in excess of
     5  one hundred eighty days by restaurants  or  establishments  licensed  to
     6  sell  alcoholic  beverages  at  retail  for consumption on the premises,
     7  provided the local municipality in which such establishment  is  located
     8  has elected to permit such use.
     9    § 2. This act shall take effect immediately.
