       AN ACT to amend the highway law, in relation to permitting two  or  more
         towns to jointly purchase highway equipment
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Section 142 of the highway law is amended by adding  a  new
    2  subdivision 6 to read as follows:
    3    6.  A. TWO OR MORE CONTIGUOUS TOWNS MAY, UPON THE REQUEST OF THE HIGH-
    4  WAY SUPERINTENDENTS OF SUCH TOWNS AND BY A MAJORITY VOTE OF EACH OF  THE
    5  TOWN  BOARDS  OF SUCH TWO OR MORE CONTIGUOUS TOWNS AUTHORIZE THE HIGHWAY
    6  SUPERINTENDENTS OF SUCH TOWNS TO PURCHASE AND  PROVIDE  FOR  STORAGE  OF
    7  HIGHWAY EQUIPMENT AS PROVIDED IN THIS SECTION.
    8    B.  EACH TOWN THAT SO ELECTS TO PARTICIPATE SHALL BY RESOLUTION OF THE
    9  TOWN BOARD AUTHORIZE EXPENDITURE OF  FUNDS  FOR  THE  PURPOSE  OF  JOINT
   10  PURCHASE AND USE OF HIGHWAY EQUIPMENT.
   11    C.  NOTWITHSTANDING  ANY  PROVISION  OF LAW TO THE CONTRARY, A VILLAGE
   12  PARTIALLY OR WHOLLY CONTAINED WITHIN A TOWN THAT PARTICIPATES IN A JOINT
   13  HIGHWAY EQUIPMENT PURCHASE SHALL NOT BE REQUIRED BUT MAY, BY  RESOLUTION
   14  OF  THE  VILLAGE BOARD, ELECT TO PARTICIPATE IN A JOINT TOWN PURCHASE OF
   15  HIGHWAY EQUIPMENT.
   16    S 2. This act shall take effect immediately.
