STATE OF NEW YORK ________________________________________________________________________ 3503 2025-2026 Regular Sessions IN SENATE January 28, 2025 ___________ Introduced by Sen. WEIK -- read twice and ordered printed, and when printed to be committed to the Committee on Education AN ACT to amend the education law, in relation to requiring yearly cardiac fitness certificates including an electrocardiogram or echo- cardiogram for interscholastic athletes in all public schools The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The education law is amended by adding a new section 903-a 2 to read as follows: 3 § 903-a. Cardiac fitness certificate. A cardiac fitness certificate 4 shall be furnished by each student in public schools before such student 5 is permitted to participate in interscholastic athletics. Each such 6 certificate shall be signed by a duly licensed physician, physician 7 assistant, or nurse practitioner, who is authorized by law to practice 8 in this state, and consistent with subdivision three of section sixty- 9 nine hundred two of this chapter, or by a duly licensed physician, 10 physician assistant, or nurse practitioner, who is authorized to prac- 11 tice in the jurisdiction in which the examination was given, provided 12 that the commissioner has determined that such jurisdiction has stand- 13 ards of licensure and practice comparable to those of New York. Each 14 such certificate shall describe the cardiac fitness of the student when 15 the examination was made, which shall not be more than twelve months 16 prior to the commencement of the interscholastic athletic season, and 17 shall state whether such student has any heart conditions and if such 18 heart conditions could result in severe adverse health outcomes during 19 athletic activity. Such physician, physician assistant or nurse practi- 20 tioner shall conduct an electrocardiogram or an echocardiogram and the 21 certificate shall state the results. 22 § 2. This act shall take effect on the first of July next succeeding 23 the date upon which it shall have become a law. Effective immediately, 24 the addition, amendment and/or repeal of any rule or regulation neces- 25 sary for the implementation of this act on its effective date are 26 authorized to be made and completed on or before such date.
