STATE OF NEW YORK ________________________________________________________________________ 4053 2019-2020 Regular Sessions IN SENATE February 26, 2019 ___________ Introduced by Sen. ANTONACCI -- read twice and ordered printed, and when printed to be committed to the Committee on Finance AN ACT to amend the state finance law, in relation to state procurement oversight The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The state finance law is amended by adding a new section 2 161-a to read as follows: 3 § 161-a. State procurement and public work oversight panel. There 4 shall be a state procurement and public work oversight panel charged 5 with the independent oversight of all state procurements and public 6 works of ten million dollars or more by all state agencies and state 7 authorities. The panel shall consist of five members; one each appointed 8 by the governor, the comptroller, the attorney general, the temporary 9 president of the senate and the speaker of the assembly. The panel shall 10 make recommendations to the legislature to ensure the wise and prudent 11 use of public money in the best interests of the taxpayers of the state 12 and guard against favoritism, improvidence, extravagance, fraud and 13 corruption in connection with large procurements and public works of 14 state agencies and state authorities. The panel shall review each and 15 every procurement and public work by a state agency and authority of ten 16 million dollars or more at key intervals of the procurement process, 17 including but not limited to the final award, to ensure the process is 18 open, fair and competitive. The state agency or authority in charge of 19 the procurement or public work shall fully assist the panel in its 20 review and promptly provide any information and documentation needed or 21 requested by the panel to conduct its review. The panel may recommend 22 utilization of other state agencies or authorities to assist project 23 management to ensure on-time on-budget delivery. 24 § 2. This act shall take effect immediately.
