        Introduced  by  Sen. MATTERA -- read twice and ordered printed, and when
          printed to be committed to the Committee on Codes

        AN ACT to amend the penal law, in relation to aggravated  harassment  in
          the second degree

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Subdivision 3-a of section 240.30  of  the  penal  law,  as
     2  added  by  section  1  of  part  Z of chapter 55 of the laws of 2024, is
     3  amended to read as follows:
     4    3-a. With the intent to  harass,  annoy,  threaten  or  alarm  another
     5  person,  such  person  strikes,  shoves,  kicks, throws something at, or
     6  otherwise subjects another person to physical  contact,  which  includes
     7  spitting  on  such other person, and such other person is a train opera-
     8  tor, ticket inspector, conductor, signalperson,  bus  operator,  station
     9  agent,  station  cleaner,  terminal cleaner, station customer assistant,
    10  traffic checker; person  whose  official  duties  include  the  sale  or
    11  collection  of tickets, passes, vouchers, or other revenue payment media
    12  for use on a train, bus, or ferry  or  the  collection  or  handling  of
    13  revenues  therefrom;  a person whose official duties include the manage-
    14  ment, administration, operation,  construction,  security,  safety,  law
    15  enforcement,  incident  response, maintenance, repair, inspection, trou-
    16  bleshooting, testing or cleaning of or at buses or  ferries,  a  transit
    17  signal  system,  elevated  or underground subway tracks, transit station
    18  structure, including fare equipment,  escalators,  elevators  and  other
    19  equipment  necessary  to  passenger  service,  commuter  rail  tracks or
    20  stations, train yard,  revenue  train  in  passenger  service,  a  ferry
    21  station,  or  a  train  or  bus station or terminal, roadways, walkways,
    22  tunnels, bridges, central business district, tolling facilities or their
    23  supporting systems, buildings or structures, vehicle towing,  or  opera-
    24  tion  of  any  vehicle  of any transit or tolling agency or authority or
    25  company; or a supervisor, manager, or administrator of  such  personnel,

     1  employed  or  contracted  by any transit or tolling agency, authority or
     2  company, public or private, whose operation is authorized or established
     3  by New York state or any of its political subdivisions while such  indi-
     4  vidual is performing an assigned duty; or
     5    § 2. This act shall take effect immediately.
