BONACIC -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government -- reported favorably from said committee, ordered to first and second report, ordered to a third reading, passed by Senate and delivered to the Assembly, recalled, vote reconsidered, restored to third reading, amended and ordered reprinted, retaining its place in the order of third reading AN ACT to amend the town law and the public officers law, in relation to the residency of the building inspector and code enforcement officer of the town of Wallkill, in the county of Orange The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 23 of the town law is amended by adding a new 2 subdivision 31 to read as follows: 3 31. Notwithstanding the provisions of subdivision one of this section, 4 in the town of Wallkill, in the county of Orange, the persons performing 5 the functions of town building inspector and code enforcement officer 6 need not be electors of such town. Provided, however, the persons 7 performing the functions of building inspector and code enforcement 8 officer in any other town shall be electors of such town, unless other- 9 wise provided by law. 10 § 2. Section 3 of the public officers law is amended by adding a new 11 subdivision 66 to read as follows: 12 66. In the town of Wallkill, in the county of Orange, the provisions 13 of this section requiring a person to be a resident of a political 14 subdivision or municipal corporation of the state for which he or she 15 shall be chosen or within which his or her official functions are 16 required to be exercised, shall not prevent a person from holding the 17 office of building inspector and code enforcement officer of the town of 18 Wallkill, provided that such person resides in the county in which such 19 town is located. Provided, however, the persons performing the functions 20 of building inspector and code enforcement officer in any other town 21 shall be residents of such town, unless otherwise provided by law. 22 § 3.
