       Introduced  by  Sen.  AVELLA -- read twice and ordered printed, and when
         printed to be committed  to  the  Committee  on  Cities  --  committee
         discharged, bill amended, ordered reprinted as amended and recommitted
         to said committee
       AN  ACT  to  amend  the  administrative code of the city of New York, in
         relation to requiring plan examiners to approve all  applications  and
         inspections
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Section 28-105.5 of the administrative code of the city  of
    2  New  York,  as  added by local law number 33 of the city of New York for
    3  the year 2007, is amended to read as follows:
    4    S28-105.5 Application for permit. All applications for  permits  shall
    5  be  submitted  on  forms furnished by the department. Applications shall
    6  include all information required by this code, other applicable  law  or
    7  the  rules  of  the department. The applicant shall list any portions of
    8  the design that have been approved for deferred submittal in  accordance
    9  with  section  28-104.2.6. The application shall set forth an inspection
   10  program for the job. An application for a permit shall be  submitted  no
   11  later  than  12  months  after the approval of all required construction
   12  documents (other than those documents approved for deferred  submittal).
   13  ALL PERMIT APPLICATIONS, INCLUDING AMENDED PERMIT APPLICATIONS FOR ITEMS
   14  ELIGIBLE  FOR  DEFERRED SUBMITTAL PURSUANT TO SECTION 28-104.2.6 OF THIS
   15  CHAPTER, WITH THE EXCEPTION OF PERMIT APPLICATIONS FOR COOPERATIVES  AND
   16  CONDOMINIUMS, SHALL BE REVIEWED AND APPROVED BY A PLAN EXAMINER PRIOR TO
   17  ITS ISSUANCE BY THE COMMISSIONER.
   18    S  2.  This  act  shall take effect immediately and shall apply to any
   19  application or inspection made after such effective date.
