       Introduced  by  Sen.  BALL  --  read twice and ordered printed, and when
         printed to be committed to the Committee on Civil Service and Pensions
       AN ACT to prohibit  the  reduction  of  the  disability  retirements  of
         responders,  injured  at  the site of the World Trade Center terrorist
         attack, by any workers' compensation payments received by  such  first
         responders
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Notwithstanding any provision of law to the  contrary,  the
    2  disability  retirement benefits from any public retirement system of the
    3  state, as defined in section 501 of the retirement and  social  security
    4  law,  of  any  retired member of such system who was a police officer, a
    5  firefighter or certified first responder, as defined in section 3001  of
    6  the  public  health  law,  and whose disability arose as the natural and
    7  proximate result of participation in  the  rescue  effort  conducted  in
    8  response  to  the  World Trade Center attack on September 1, 2001, shall
    9  not be reduced or set off by the amounts of  any  workers'  compensation
   10  benefits paid or payable to such retiree.
   11    All workers' compensation benefits paid or payable to every such reti-
   12  ree, shall be payable in addition to any disability retirement for which
   13  the retiree is eligible.
   14    S 2. This act shall take effect immediately.
