        Introduced  by  Sen.  COMRIE -- read twice and ordered printed, and when
          printed to be committed to the Committee on Transportation

        AN ACT in relation to postponing  fare  increases  during  the  COVID-19
          pandemic;  authorizing  the  metropolitan  transportation authority to
          conduct a study on reducing fares; and providing  for  the  repeal  of
          such provisions upon expiration thereof

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. The Metropolitan Transportation  Authority  shall  postpone
     2  any  proposed  fare,  toll,  rate,  charge or other fee increase for the
     3  transportation of passengers until the end  of  the  COVID-19  emergency
     4  declaration and the completion of an economic feasibility study. For the
     5  purposes  of  this  act, "COVID-19 emergency declaration" shall mean the
     6  state disaster emergency declared for  the  entire  state  by  executive
     7  order number 202 and any further amendments or modifications, and as may
     8  be further extended pursuant to section 28 of the executive law.
     9    §  2.  (a)  The Metropolitan Transportation Authority shall conduct an
    10  economic feasibility study and make recommendations on  reducing  fares,
    11  tolls, rates, charges or other fees for the transportation of passengers
    12  to increase ridership.
    13    (b) The Metropolitan Transportation Authority shall create a report of
    14  its  findings  and recommendations and deliver such report to the gover-
    15  nor, the speaker of the assembly, the minority leader of  the  assembly,
    16  the  temporary  president  of  the senate and the minority leader of the
    17  senate three months after the effective date of this act.
    18    § 3. This act shall take effect immediately, provided, however:
    19    (a) section one of this act shall be subject to the expiration of  the
    20  state  disaster  emergency  declared  for  the entire state by executive
    21  order number 202 and any further amendments or modifications, and as may
    22  be further extended pursuant to section 28 of  the  executive  law,  and
    23  shall  be deemed to expire and be repealed therewith; provided, further,

     1  that the chairman of the  metropolitan  transportation  authority  shall
     2  notify  the  legislative bill drafting commission upon the occurrence of
     3  the expiration of the state disaster  emergency  declared  by  executive
     4  order  number  202  of 2020 and any further amendments or modifications,
     5  and as may be further extended pursuant to section 28 of  the  executive
     6  law,  in  order  that the commission may maintain an accurate and timely
     7  effective data base of the official text of the laws of the state of New
     8  York in furtherance of effectuating the provisions of section 44 of  the
     9  legislative law and section 70-b of the public officers law; and
    10    (b)  section two of this act shall expire and be deemed repealed sixty
    11  days after the metropolitan transportation authority delivers the report
    12  described in section two of this act to the governor, the speaker of the
    13  assembly, the minority leader of the assembly, the  temporary  president
    14  of  the senate and the minority leader of the senate; provided, further,
    15  that the chairman of the  metropolitan  transportation  authority  shall
    16  notify  the  legislative bill drafting commission upon the occurrence of
    17  the delivery of such report, in order that the commission  may  maintain
    18  an  accurate  and timely effective data base of the official text of the
    19  laws of the state  of  New  York  in  furtherance  of  effectuating  the
    20  provisions  of section 44 of the legislative law and section 70-b of the
    21  public officers law.
