CARLUCCI -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT to authorize the town of Ramapo to file an application for exemption from real property taxes for certain parcels of land located in the town of Ramapo, county of Rockland THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Notwithstanding any other provision of law to the contrary, 2 the assessor of the town of Ramapo, is hereby authorized to accept from 3 the town of Ramapo, an application for exemption from real property 4 taxes pursuant to section 406 of the real property tax law for the 2009 5 assessment roll, for the parcels owned by such town, which are located 6 in the town of Ramapo at 982 Route 45, otherwise known as: section 7 33.15, block 1, lots 5 and 10. If accepted, such application shall be 8 reviewed as if it had been received on or before the applicable deadline 9 for filing such applications established for such roll. 10 If satisfied that such town: (i) acquired title to the property for 11 which it seeks exemption and (ii) would otherwise be entitled to such 12 exemption if such town had acquired such property by the appropriate 13 taxable status date, the assessor, upon approval by the town board of 14 the town of Ramapo, may grant exemption from all taxation beginning with 15 the date of acquisition of the property by such town and make appropri- 16 ate correction to the subject roll. If exemption is granted and such 17 town therefore shall have paid any tax with respect to the subject roll, 18 the governing body or tax department may, in its sole discretion, 19 provide for the refund of those taxes paid and cancel taxes, fines, 20 penalties or interest remaining unpaid. 21 S 2.
