STATE OF NEW YORK ________________________________________________________________________ 4709 2021-2022 Regular Sessions IN SENATE February 9, 2021 ___________ Introduced by Sens. STEC, SERINO -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to requiring the department of health to publish and update COVID-19 vaccination distribution data on its website on a weekly basis The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The public health law is amended by adding a new section 2 206-c to read as follows: 3 § 206-c. Special requirements with respect to COVID-19 vaccine 4 distribution data. 1. For purposes of this section, the following terms 5 shall have the following meanings: 6 (a) "Distribution phase" shall mean the phase of eligibility of the 7 recipient for the COVID-19 vaccine as provided for in the New York state 8 COVID-19 vaccination program. 9 (b) "Eligible recipient" shall mean an individual qualified to receive 10 the COVID-19 vaccine under the New York state COVID-19 vaccination 11 distribution program. 12 (c) "Pharmacy Partnership for Long-Term Care Program" shall mean the 13 federal Centers for Disease Control's program to provide on-site COVID- 14 19 vaccination to residents and staff of long-term care facilities. 15 2. The commissioner shall compile and post on the department's website 16 in a conspicuous location and in a format capable of download in a 17 spreadsheet format, the following data on a weekly basis: 18 (a) the total number of COVID-19 vaccines allocated to New York state 19 by the federal government; 20 (b) the total number of COVID-19 vaccines requested by New York state 21 from the federal government; 22 (c) the total number of COVID-19 vaccines received by New York state 23 from the federal government; EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD09435-02-1S. 4709 2 1 (d) the total number of COVID-19 vaccines administered to eligible 2 recipients under the New York state COVID-19 vaccination program and the 3 Pharmacy Partnership for Long-Term Care Program; and 4 (e) the total number of COVID-19 vaccines declined by eligible recipi- 5 ents under the New York state COVID-19 vaccination program and the Phar- 6 macy Partnership for Long-Term Care Program. 7 3. The data posted pursuant to subdivision two of this section shall 8 be organized by county, date, facility, age of the eligible recipient, 9 race of the eligible recipient, ethnicity of the eligible recipient, the 10 distribution phase of the eligible recipient and shall include all such 11 data retroactive to December fourteenth, two thousand twenty. 12 § 2. This act shall take effect immediately.
