        Introduced  by  Sen.  BAILEY -- read twice and ordered printed, and when
          printed to be committed to the Committee on Health

        AN ACT to amend the public health law,  in  relation  to  instituting  a
          moratorium on the closure of hospitals during a pandemic

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. The public health law is amended by adding  a  new  section
     2  2832 to read as follows:
     3    §  2832. Hospital closure moratorium during pandemics. Notwithstanding
     4  any provisions of law, rule or regulation to  the  contrary,  the  state
     5  shall  institute  a  moratorium  on  the closure of hospitals during any
     6  state of emergency declared due to a pandemic.  During such  moratorium,
     7  no hospital shall close or reduce capacity below the hospital's capacity
     8  as of the date the moratorium was imposed.
     9    § 2. This act shall take effect immediately.
