        Introduced  by  Sen.  DIAZ  --  read twice and ordered printed, and when
          printed to be committed to the Committee on Codes
        AN ACT to amend the penal law, in relation to making incest  a  class  B
          felony
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
     1    Section 1. The second undesignated paragraph of section 255.25 of  the
     2  penal  law, as amended by chapter 320 of the laws of 2006, is amended to
     3  read as follows:
     4    Incest in the third degree is a class [E] B felony.
     5    § 2. The second undesignated paragraph of section 255.26 of the  penal
     6  law,  as added by chapter 320 of the laws of 2006, is amended to read as
     7  follows:
     8    Incest in the second degree is a class [D] B felony.
     9    § 3. This act shall take effect on the first of November next succeed-
    10  ing the date on which it shall have become a law.
         EXPLANATION--Matter in italics (underscored) is new; matter in brackets
                              [ ] is old law to be omitted.
