PERSAUD, CLEARE, COMRIE, GONZALEZ, HOYLMAN-SIGAL, PARKER, SALAZAR -- read twice and ordered printed, and when printed to be committed to the Committee on Social Services -- recommitted to the Committee on Social Services in accordance with Senate Rule 6, sec. 8 -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to amend the social services law, in relation to increasing the standards of monthly need and home energy grant amounts for persons in receipt of public assistance The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Paragraph (a-4) of subdivision 2 of section 131-a of the 2 social services law, as added by section 1 of part D of chapter 57 of 3 the laws of 2012, is amended and a new paragraph (a-5) is added to read 4 as follows: 5 (a-4) For the period beginning October first, two thousand twelve and 6 [thereafter] ending June thirtieth, two thousand twenty-four, the 7 following shall be the standard of monthly need for determining eligi- 8 bility for all categories of assistance in and by all social services 9 districts: 10 Number of Persons in Household 11 One Two Three Four Five Six 12 $158 $252 $336 $433 $534 $617 13 For each additional person in the household there shall be added an 14 additional amount of eighty-five dollars monthly. 15 (a-5) For the period beginning July first, two thousand twenty-four, 16 the following shall be the standard of monthly need for determining 17 eligibility for all categories of assistance in and by all social 18 services districts: 19 Number of Persons in Household 20 One Two Three Four Five Six EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD04243-03-4S. 5270--A 2 1 $263 $420 $558 $720 $889 $1027 2 For each additional person in the household there shall be added an 3 additional amount of one hundred forty-one dollars monthly. 4 Annually thereafter, the standard of monthly need for determining 5 eligibility for all categories of assistance in and by all social 6 services districts shall be increased based on the current cost of 7 living adjustments as determined by the federal social security adminis- 8 tration. 9 § 2. Paragraph (a-4) of subdivision 3 of section 131-a of the social 10 services law, as added by section 2 of part D of chapter 57 of the laws 11 of 2012, is amended and a new paragraph (a-5) is added to read as 12 follows: 13 (a-4) For the period beginning October first, two thousand twelve and 14 [thereafter] ending June thirtieth, two thousand twenty-four, persons 15 and families determined to be eligible by the application of the stand- 16 ard of need prescribed by the provisions of subdivision two of this 17 section, less any available income or resources which are not required 18 to be disregarded by other provisions of this chapter, shall receive 19 maximum monthly grants and allowances in all social services districts, 20 in accordance with the following schedule, for public assistance: 21 Number of Persons in Household 22 One Two Three Four Five Six 23 $158 $252 $336 $433 $534 $617 24 For each additional person in the household there shall be added an 25 additional amount of eighty-five dollars monthly. 26 (a-5) For the period beginning July first, two thousand twenty-four, 27 persons and families determined to be eligible by the application of the 28 standard of need prescribed by the provisions of subdivision two of this 29 section, less any available income or resources which are not required 30 to be disregarded by other provisions of this chapter, shall receive 31 maximum monthly grants and allowances in all social services districts, 32 in accordance with the following schedule, for public assistance: 33 Number of Persons in Household 34 One Two Three Four Five Six 35 $263 $420 $558 $720 $889 $1027 36 For each additional person in the household there shall be added an 37 additional amount of one hundred forty-one dollars monthly. 38 Annually thereafter, the standard of monthly need for determining 39 eligibility for all categories of assistance in and by all social 40 services districts shall be increased based on the current cost of 41 living adjustments as determined by the federal social security adminis- 42 tration. 43 § 3. Subdivision 3-c of section 131-a of the social services law, as 44 amended by chapter 77 of the laws of 1989, is amended to read as 45 follows: 46 3-c. (a) Commencing July first, nineteen hundred eighty-one and ending 47 June thirtieth, two thousand twenty-four, persons and families deter- 48 mined to be eligible by the application of the standard of need 49 prescribed by the provision of subdivision two of this section, shall 50 receive a home energy grant equal to the following monthly amounts: 51 Number of Persons in Household 52 One Two Three Four Five Six 53 $14.10 $22.50 $30.00 $38.70 $47.70 $55.20 54 For each additional needy person in the household, there shall be 55 added an additional amount of seven dollars and fifty cents.S. 5270--A 3 1 (b) For the period beginning July first, two thousand twenty-four, 2 persons and families determined to be eligible by the application of the 3 standard of need prescribed by the provisions of subdivision two of this 4 section, shall receive a home energy grant equal to the following month- 5 ly amounts: 6 Number of Persons in Household 7 One Two Three Four Five Six 8 $47 $75 $100 $128 $158 $183 9 For each additional needy person in the household there shall be added 10 an additional amount of twenty-five dollars. 11 Annually thereafter, the standard of monthly need for determining 12 eligibility for all categories of assistance in and by all social 13 services districts shall be increased based on the current cost of 14 living adjustments as determined by the federal social security adminis- 15 tration. 16 § 4. Subdivision 3-d of section 131-a of the social services law, as 17 added by chapter 60 of the laws of 1985, is amended to read as follows: 18 3-d. (a) Commencing January first, nineteen hundred eighty-six and 19 ending June thirtieth, two thousand twenty-four, for persons and fami- 20 lies determined to be eligible by the application of the standard of 21 need prescribed by the provisions of subdivision two of this section, 22 the amounts set forth in paragraph (a) of subdivision three of this 23 section, after application of subdivision three-c of this section, shall 24 be increased by the following amounts as a monthly supplemental home 25 energy grant: 26 Number of Persons in Household 27 One Two Three Four Five Six 28 $11 $17 $23 $30 $37 $42 29 For each additional needy person in the household, there shall be 30 added an additional amount of five dollars monthly. 31 (b) For the period beginning July first, two thousand twenty-four, for 32 persons and families determined to be eligible by the application of the 33 standard of need prescribed by the provisions of subdivision two of this 34 section, the amounts set forth in paragraph (a) of subdivision three of 35 this section, after application of subdivision three-c of this section, 36 shall be increased by the following amounts as a monthly supplemental 37 home energy grant: 38 Number of Persons in Household 39 One Two Three Four Five Six 40 $30 $46 $62 $81 $100 $114 41 For each additional needy person in the household, there shall be 42 added an additional amount of fourteen dollars monthly. 43 Annually thereafter, the standard of monthly need for determining 44 eligibility for all categories of assistance in and by all social 45 services districts shall be increased based on the current cost of 46 living adjustments as determined by the federal social security adminis- 47 tration. 48 § 5. This act shall take effect immediately.
