         cations
       AN  ACT  to  amend  the public authorities law, in relation to the green
         jobs-green New York revolving loan fund
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1.  Subparagraph  (iv)  of  paragraph (c) of subdivision 1 of
    2  section 1896 of the public authorities law, as amended by chapter 388 of
    3  the laws of 2011, is amended to read as follows:
    4    (iv) establish standards for customer participation  in  such  on-bill
    5  recovery  mechanism,  including  standards  for  reliable  utility  bill
    6  payment, current good standing on any  mortgage  obligations,  and  such
    7  additional  standards as the authority deems necessary; provided that in
    8  order to provide broad access to on-bill recovery, the authority  shall,
    9  to  the  fullest  extent  practicable,  consider alternative measures of
   10  creditworthiness that are prudent in order to include  participation  by
   11  customers  who  are less likely to have access to traditional sources of
   12  financing. STANDARDS FOR CUSTOMER PARTICIPATION MAY NOT HOWEVER  INCLUDE
   13  A  DETERMINATION OF A CUSTOMER'S CREDITWORTHINESS BUT SHOULD BE BASED ON
   14  THE CUSTOMER'S PAST UTILITY BILL PAYMENT HISTORY;
   15    S 2. Subdivisions 3 and 4 of section 1893 of  the  public  authorities
   16  law,  as added by chapter 487 of the laws of 2009, are amended and a new
   17  subdivision 5 is added to read as follows:
   18    3. enter into contracts with  one  or  more  program  implementers  to
   19  perform such functions as the authority deems appropriate; [and]
   20    4. exercise such other powers as are necessary for the proper adminis-
   21  tration of the program[.]; AND
   22    5.  DISTRIBUTE  THE  FUNDS SO THAT THIRTY-TWO PERCENT OF THE FUNDS ARE
   23  ALLOCATED TO NEW YORK CITY AND SIXTY-TWO PERCENT  TO  THE  REST  OF  THE
   24  STATE.

    1    S  3. The commissioner of the department of environmental conservation
    2  shall provide for the deposit of  one  hundred  thirty  million  dollars
    3  ($130,000,000)  from  revenues  collected  under direct oversight by the
    4  department of environmental conservation, from the auction of any  emis-
    5  sions  allowances  for air contaminants to the green jobs-green New York
    6  revolving loan fund, established pursuant to section 1896 of the  public
    7  authorities law. Fifty million dollars shall be allocated for use within
    8  New  York city and eighty million dollars shall be allocated outside the
    9  city of New York.
   10    S 4. This act shall take effect immediately.
