        Introduced by Sen. FERNANDEZ -- read twice and ordered printed, and when
          printed  to  be committed to the Committee on Alcoholism and Substance
          Use Disorders

        AN ACT to amend the mental hygiene law, in relation to  designating  the
          members  of  the  opioid  settlement  board as public officers for the
          purposes of the public officers law

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1.  Paragraph  4  of  subdivision (c) of section 25.18 of the
     2  mental hygiene law, as amended by chapter 171 of the laws  of  2022,  is
     3  amended to read as follows:
     4    4. Each member shall be appointed to serve three-year terms and in the
     5  event  of  a  vacancy,  the vacancy shall be filled in the manner of the
     6  original appointment for  the  remainder  of  the  term.  The  appointed
     7  members  and  commissioners  shall  receive  no  compensation  for their
     8  services but shall  be  allowed  their  actual  and  necessary  expenses
     9  incurred  in  the performance of their duties as board members.  Members
    10  of the board shall be considered public officers  for  purposes  of  the
    11  public officers law.
    12    § 2. This act shall take effect immediately.
