       Introduced  by  Sen.  FELDER -- read twice and ordered printed, and when
         printed to be committed to the Committee on Children and Families
       AN ACT to amend the education law, in relation  to  the  use  of  school
         buildings for school age child care
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Section 409 of the education law is amended by adding a new
    2  subdivision 3 to read as follows:
    3    3. NOTWITHSTANDING THE PROVISIONS OF ANY  OTHER  LAW,  RULE  OR  REGU-
    4  LATION,  THE  RULES  AND REGULATIONS PROMULGATED IN ACCORDANCE WITH THIS
    5  SECTION SHALL  PREEMPT  ANY  CONTRADICTORY  REGULATIONS  PROMULGATED  BY
    6  ANOTHER  STATE  AGENCY,  RELATING  TO  THE USE OF A SCHOOL BUILDING BY A
    7  REGISTERED THIRD PARTY PROVIDING SCHOOL AGE CHILD  CARE  AS  DEFINED  IN
    8  PARAGRAPH  (F) OF SUBDIVISION ONE OF SECTION THREE HUNDRED NINETY OF THE
    9  SOCIAL SERVICES LAW.
   10    S 2. This act shall take effect immediately.
