GOLDEN -- read twice and ordered printed, and when printed to be committed to the Committee on Education -- committee discharged and said bill committed to the Committee on Rules -- ordered to a third reading, amended and ordered reprinted, retaining its place in the order of third reading -- recommitted to the Commit- tee on Education in accordance with Senate Rule 6, sec. 8 -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to amend the education law, in relation to approval of leases THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Subdivision 6 of section 2554 of the education law, as 2 amended by chapter 170 of the laws of 1994, is amended to read as 3 follows: 4 6. To lease property required for the purpose of furnishing school 5 accommodations for schools administered by the board of education and to 6 prepare and execute leases therefor. To be eligible for aid pursuant to 7 subdivision six of section thirty-six hundred two of this chapter, any 8 such lease shall be approved by the commissioner prior to execution, 9 PROVIDED THAT THE COMMISSIONER MAY APPROVE A LEASE SUBMITTED FOR 10 APPROVAL AFTER EXECUTION UPON A SHOWING OF GOOD CAUSE FOR THE DELAY; the 11 leased space shall meet requirements for access by individuals with 12 disabilities to both facilities and programs, as defined in regulations 13 of the commissioner; the requirements set forth in paragraphs a, b, c, d 14 and f of subdivision one of section four hundred three-b of this chapter 15 shall be met, except for the requirement of voter approval; and the 16 leased space shall be used to house programs for pupils in grades prek- 17 indergarten through twelve, other than programs funded pursuant to 18 section forty-four hundred ten of this chapter, with minimal associated 19 administrative and support services space as approved by the commission- 20 er. 21 S 2.
