STATE OF NEW YORK ________________________________________________________________________ 6234 2021-2022 Regular Sessions IN SENATE April 16, 2021 ___________ Introduced by Sen. KENNEDY -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to exempting certain members of the armed forces and dependents to operate a motor vehicle or motorcycle on the public highways of this state without being licensed in New York The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 251 of the vehicle and traffic law is amended by 2 adding a new subdivision 2-a to read as follows: 3 2-a. A member of the armed forces and any dependent of such person 4 sixteen years of age or older who has complied with the laws of a state, 5 territory, federal district or foreign country which require such 6 person, in order to operate a motor vehicle or motorcycle therein, to be 7 licensed, may operate or drive a motor vehicle or motorcycle on the 8 public highways of this state without being so licensed under this chap- 9 ter. Provided, however, that the recognition granted under this subdivi- 10 sion shall, with respect to a person under the age of eighteen years, 11 only permit the operation of a motor vehicle or motorcycle in this state 12 in accordance with the same restrictions imposed upon New York residents 13 operating or driving motor vehicles or motorcycles with class DJ or MJ 14 licenses under subdivision three of section five hundred one of this 15 chapter. The exemption granted in this subdivision shall not apply to 16 persons whose privilege of operating a motor vehicle in this state, or 17 whose former license to drive in this state, has been suspended or 18 revoked, until such suspension or revocation has been terminated or 19 privilege of operating a motor vehicle restored. Notwithstanding the 20 provisions of subdivision four of this section, for purposes of this 21 subdivision, "member of the armed forces" shall mean a person on active 22 duty, other than annual active duty for training, in a branch of the 23 armed forces of the United States and "dependent" shall mean a spouse or 24 child of a member of the armed forces residing in the same household and 25 dependent upon such member of the armed forces for support. 26 § 2.
