         when printed to be committed to the Committee on Transportation
       AN ACT to amend the vehicle and traffic law, in relation to  prohibiting
         motor  vehicles engaged in retail sales of frozen desserts directly to
         consumers from turning right at red lights
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Subparagraph a of paragraph 2 of subdivision (d) of section
    2  1111  of  the vehicle and traffic law, as separately amended by chapters
    3  230 and 420 of the laws of 1980, is amended to read as follows:
    4    a. Traffic, EXCEPT MOTOR VEHICLES ENGAGED IN RETAIL  SALES  OF  FROZEN
    5  DESSERTS  DIRECTLY TO CONSUMERS AS REGULATED BY SUBDIVISION THIRTY-SEVEN
    6  OF SECTION THREE HUNDRED SEVENTY-FIVE OF THIS CHAPTER, facing  a  steady
    7  circular  red  signal  may  cautiously  enter the intersection to make a
    8  right turn after stopping as required by paragraph one of this  subdivi-
    9  sion,  except  that right turning traffic is not required to stop when a
   10  steady right green arrow signal is shown at the same time. Such  traffic
   11  shall  yield the right-of-way to pedestrians within a marked or unmarked
   12  crosswalk at the intersection and to other traffic  lawfully  using  the
   13  intersection;
   14    S 2. This act shall take effect on the one hundred twentieth day after
   15  it  shall have become a law. Effective immediately, the addition, amend-
   16  ment and/or repeal of any rule or regulation necessary for the implemen-
   17  tation of this act on its effective date is authorized to be made on  or
   18  before such date.
