        AN  ACT  to  amend  the  alcoholic  beverage control law, in relation to
          special permits to sell alcohol at certain times on Sundays
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
     1    Section  1. Paragraph (a) of subdivision 5 of section 106 of the alco-
     2  holic beverage control law, as amended by chapter  83  of  the  laws  of
     3  1995, is amended to read as follows:
     4    (a)  Sunday, from four ante meridiem to twelve noon, except by special
     5  permit.
     6    § 2. Section 99 of the alcoholic beverage control law, as  amended  by
     7  chapter  204  of  the  laws  of 1963, subdivisions 1 and 2 as amended by
     8  section 22 of part Z of chapter 85 of the laws of 2002,  is  amended  to
     9  read as follows:
    10    § 99. Special  permit to remain open during certain hours of the morn-
    11  ing.  1. Any person licensed to sell alcoholic beverages for consumption
    12  on the premises pursuant to this chapter may apply to the liquor author-
    13  ity for a special permit to remain open on  any  week  day  between  the
    14  hours  of  four  o'clock  a.m.  or the closing hour prescribed by a rule
    15  adopted in a county on or before April first, nineteen  hundred  ninety-
    16  five  or  pursuant  to  subdivision  eleven of section seventeen of this
    17  chapter, and eight o'clock a.m. The fee for such permit shall be  fifty-
    18  one dollars per day.
    19    2.  The  liquor  authority  may,  in its discretion, issue to any such
    20  licensed person, whose premises are  located  within  a  trade  area,  a
    21  special  permit to remain open during such hours of the morning on week-
    22  days. The fee for such permit shall  be  at  the  rate  of  two  hundred
    23  fifty-six dollars per annum.
    24    3.  Any person licensed to sell alcoholic beverages for consumption on
    25  the premises pursuant to this chapter may apply to the liquor  authority
    26  for  a  special  permit to open on any Sunday between the hours of eight
    27  ante meridiem and twelve noon. Unless otherwise approved by the authori-
