STATE OF NEW YORK ________________________________________________________________________ 6571 2021-2022 Regular Sessions IN SENATE May 6, 2021 ___________ Introduced by Sen. HINCHEY -- read twice and ordered printed, and when printed to be committed to the Committee on Alcoholism and Substance Abuse AN ACT to amend the public health law, in relation to reporting of alco- hol overdose data; and to amend chapter 66 of the laws of 2016, amend- ing the public health law, relating to reporting of opioid overdose data, in relation to making such provisions permanent The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision 5 of section 3309 of the public health law, as 2 amended by chapter 66 of the laws of 2016, is amended to read as 3 follows: 4 5. The commissioner shall publish findings on statewide opioid and 5 alcohol overdose data that reviews overdose death rates and other infor- 6 mation to ascertain changes in the cause and rates of opioid and alcohol 7 overdoses, including fatal opioid and alcohol overdoses. The report 8 shall be submitted annually, on or before October first, to the gover- 9 nor, the temporary president of the senate, the speaker of the assembly 10 and the chairs of the senate and assembly health committees, and shall 11 be made public on the department's internet website. The report shall 12 include, at a minimum, the following information on a county basis: 13 (a) information on opioid and alcohol overdoses and opioid and alcohol 14 overdose deaths, including age, gender, ethnicity, and geographic 15 location; 16 (b) data on emergency room utilization for the treatment of opioid and 17 alcohol overdose; 18 (c) data on utilization of pre-hospital services; 19 (d) data on the dispensing and utilization of opioid antagonists; and 20 (e) any other information necessary to ascertain the success of the 21 program, areas of the state which are experiencing particularly high 22 rates of overdoses, ways to determine if services, resources and EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD09687-03-1S. 6571 2 1 responses in particular areas of the state are having a positive impact 2 on reducing overdoses, and ways to further reduce overdoses. 3 § 2. Subdivision 6 of section 3309 of the public health law, as 4 amended by section 1 of part B of chapter 70 of the laws of 2016, is 5 amended to read as follows: 6 6. The commissioner shall provide the current information and data 7 specified by each type of drug included in the report required by subdi- 8 vision five of this section to each county every three months. Such 9 information and data shall be posted on the office of addiction services 10 and supports' website and may be utilized by a county or any combination 11 thereof as it works to address the opioid epidemic. 12 § 3. Paragraphs (c) and (d) of subdivision 3-a of section 3309 of the 13 public health law, as amended by chapter 504 of the laws of 2019, are 14 amended to read as follows: 15 (c) the number for the toll free office of [alcoholism and substance16abuse] addiction services and supports' HOPE line; 17 (d) how to access the office of [alcoholism and substance abuse18services'] addiction services and supports' website; 19 § 4. Section 2 of chapter 66 of the laws of 2016, amending the public 20 health law, relating to reporting of opioid overdose data, as amended by 21 section 12 of part S of chapter 57 of the laws of 2021, is amended to 22 read as follows: 23 § 2. This act shall take effect immediately[, provided that subdivi-24sion 6 of section 3309 of the public health law, as added by section one25of this act, shall expire and be deemed repealed March 31, 2026]. 26 § 5. This act shall take effect immediately.
