STATE OF NEW YORK ________________________________________________________________________ 6793 2023-2024 Regular Sessions IN SENATE May 10, 2023 ___________ Introduced by Sen. MARTINS -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT to amend the Nassau county civil divisions act, in relation to the Volunteer and Exempt Firemen's Benevolent Association of Williston Park The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision a of section 610.0 of the Nassau county civil 2 divisions act, as added by chapter 73 of the laws of 1940, is amended to 3 read as follows: 4 a. The corporation by the name of "Volunteer and Exempt [Firemen's] 5 Firefighter's Benevolent Association of Williston Park," is hereby 6 continued. 7 § 2. Section 610.4 of the Nassau county civil divisions act, as added 8 by chapter 73 of the laws of 1940, is amended to read as follows: 9 § Section 610.4 Control and disposal of funds and property. The 10 control and disposal of the funds, property and estate of such corpo- 11 ration and the management of its affairs shall be vested in a board of 12 trustees, which shall consist of [twelve] eighteen members of such 13 corporation, to wit: six members to be elected from either the active 14 membership or exempt membership of company number one, six members to be 15 elected from either the active membership or exempt membership of compa- 16 ny number two, and six members to be elected from either the active 17 membership or exempt membership of company number [two] three of the 18 Williston Park fire department. The officers of such corporation shall 19 be in such number and designated and shall have and exercise such powers 20 and duties as may be provided by the by-laws. The trustees and officers 21 shall be elected at the annual meeting of such corporation in the manner 22 prescribed by its by-laws. 23 § 3. Section 610.5 of the Nassau county civil divisions act, as added 24 by chapter 73 of the laws of 1940, is amended to read as follows: EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD11131-01-3S. 6793 2 1 § Section 610.5 Precept for payment of foreign fire insurance premium 2 taxes. a. Such corporation shall collect and there shall be paid to it 3 all tax imposed by section [five] nine thousand one hundred [fifty-4three] four of the insurance law, for fire department use and benefit, 5 upon premiums on policies of insurance against loss or damage by fire 6 covering property situated within the incorporated village of Williston 7 Park immediately protected by the Williston Park fire department, and 8 within any duly organized territory in which the Williston Park fire 9 department is, or may hereafter be, obligated to render fire protection. 10 b. The officer of such corporation designated by its by-laws to 11 collect and receive the aforesaid tax shall have the same powers as 12 provided by law for the treasurer of a fire department with respect to 13 such collection and receipt. 14 c. Such corporation shall also be entitled to receive a share of the 15 tax imposed by section [five] nine thousand one hundred [fifty-four] 16 five of the insurance law, based upon the premiums written in the terri- 17 tory with respect to which it is entitled to collect and receive the tax 18 under section [five hundred fifty-three] nine thousand one hundred four 19 of the insurance law. 20 d. Such taxes shall only be used [for the care and relief of disabled21or indigent volunteer and exempt firemen and their families] in further- 22 ance of its purposes set forth in section 610.1 of this act. 23 § 4. This act shall take effect immediately.
