       AN ACT to amend the mental  hygiene  law  and  the  racing,  pari-mutuel
         wagering  and breeding law, in relation to compulsive gambling assist-
         ance
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1.  Section  19.09  of  the  mental hygiene law is amended by
    2  adding two new subdivisions (i) and (j) to read as follows:
    3    (I) THE COMMISSIONER SHALL DEVELOP OR  IDENTIFY  EXISTING  EDUCATIONAL
    4  MATERIALS  WHICH  OFFER  ASSISTANCE  IN  THE PREVENTION AND TREATMENT OF
    5  COMPULSIVE GAMBLING FOR INDIVIDUALS THAT VOLUNTARILY PLACE THEMSELVES ON
    6  A SELF EXCLUSION LIST PURSUANT TO SECTION  ONE  HUNDRED  ELEVEN  OF  THE
    7  RACING,  PARI-MUTUEL WAGERING AND BREEDING LAW. SUCH EDUCATIONAL MATERI-
    8  ALS SHALL IMMEDIATELY BE TRANSMITTED TO SUCH PERSONS PLACED ON SUCH LIST
    9  AND MADE AVAILABLE TO THE GENERAL PUBLIC ON THE WEBSITES OF  THE  OFFICE
   10  AND  THE NEW YORK STATE GAMING COMMISSION. SUCH MATERIALS SHALL INCLUDE,
   11  BUT NEED NOT BE LIMITED TO, RESOURCES OR INFORMATION RELATED TO  COMPUL-
   12  SIVE GAMBLING AND CONTACT INFORMATION ON AVAILABLE TREATMENT PROGRAMS OR
   13  SUPPORT GROUPS.
   14    (J)  THE  COMMISSIONER, IN CONSULTATION WITH THE NEW YORK STATE GAMING
   15  COMMISSION, SHALL ESTABLISH A PROBLEM GAMBLING EDUCATION  PROGRAM  WHICH
   16  MAY  BE COMPLETED BY ANY INDIVIDUAL WHO HAS PLACED HIMSELF OR HERSELF ON
   17  A SELF EXCLUSION LIST PURSUANT TO SECTION  ONE  HUNDRED  ELEVEN  OF  THE
   18  RACING,  PARI-MUTUEL  WAGERING  AND  BREEDING LAW. SUCH PROGRAM SHALL BE
   19  TRANSMITTED TO ALL PERSONS PLACED ON SUCH SELF EXCLUSION LIST  AND  MADE
   20  AVAILABLE  TO  THE  GENERAL PUBLIC ON THE WEBSITES OF THE OFFICE AND NEW
   21  YORK STATE GAMING COMMISSION, AND SHALL INCLUDE, BUT NOT BE  LIMITED  TO
   22  RESOURCES  OR  INFORMATION  RELATED  TO  COMPULSIVE GAMBLING AND CONTACT
   23  INFORMATION ON AVAILABLE TREATMENT PROGRAMS OR SUPPORT GROUPS.
   24    S 2. Paragraphs (a) and (c) of subdivision 2 of  section  111  of  the
   25  racing,  pari-mutuel wagering and breeding law, as added by section 1 of
        EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets
                             [ ] is old law to be omitted.

    1  part A of chapter 60 of the  laws  of  2012,  are  amended  to  read  as
    2  follows:
    3    (a)  The  commission, IN COOPERATION WITH THE OFFICE OF ALCOHOLISM AND
    4  SUBSTANCE ABUSE SERVICES, shall promulgate rules and regulations  pursu-
    5  ant  to  which  people may: voluntarily exclude themselves from entering
    6  the premises of an association or corporation licensed  or  enfranchised
    7  by  the  commission  pursuant  to this chapter AND; RECEIVE THE REQUIRED
    8  EDUCATIONAL MATERIALS ON COMPULSIVE GAMBLING  PURSUANT  TO  SUBDIVISIONS
    9  (I) AND (J) OF SECTION 19.09 OF THE MENTAL HYGIENE LAW.
   10    (c) No voluntary order or request to exclude persons from entering the
   11  premises  of  any  such  association,  corporation,  or  facility may be
   12  rescinded, canceled, or declared null and void until [seven] THIRTY days
   13  after a request has been received by such association,  corporation,  or
   14  facility to cancel such order or request.
   15    S 3. This act shall take effect on the one hundred eightieth day after
   16  part A of chapter 60 of the laws of 2012 takes effect.
