STATE OF NEW YORK ________________________________________________________________________ 7396 IN SENATE April 27, 2016 ___________ Introduced by Sen. MURPHY -- read twice and ordered printed, and when printed to be committed to the Committee on Education AN ACT to amend the education law, in relation to requiring students to maintain a minimum grade point average as a condition to participation in certain school-sponsored clubs, teams or organizations The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 1604 of the education law is amended by adding a 2 new subdivision 43 to read as follows: 3 43. To adopt rules, as it may deem necessary, requiring students in 4 grades seven to twelve to maintain a minimum grade point average as a 5 condition to participation in a school-sponsored club, team or extracur- 6 ricular organization that regularly meets to practice and/or compete 7 interscholastically. 8 § 2. Section 1709 of the education law is amended by adding a new 9 subdivision 43 to read as follows: 10 43. To adopt rules, as it may deem necessary, requiring students in 11 grades seven to twelve to maintain a minimum grade point average as a 12 condition to participation in a school-sponsored club, team or extracur- 13 ricular organization that regularly meets to practice and/or compete 14 interscholastically. 15 § 3. Subdivision 4 of section 2503 of the education law is amended by 16 adding a new paragraph e to read as follows: 17 e. Shall adopt rules, as it may deem necessary, requiring students in 18 grades seven to twelve to maintain a minimum grade point average as a 19 condition to participation in a school-sponsored club, team or extracur- 20 ricular organization that regularly meets to practice and/or compete 21 interscholastically. 22 § 4. Section 2554 of the education law is amended by adding a new 23 subdivision 28 to read as follows: 24 28. Section 2590-e of the education law is amended by adding a new 4 subdivision 3-a to read as follows: 5 3-a. adopt rules, as it may deem necessary, requiring students in 6 junior high schools to maintain a minimum grade point average as a 7 condition to participation in a school-sponsored club, team or extracur- 8 ricular organization that regularly meets to practice and/or compete 9 interscholastically. 10 § 6. Subdivision 1 of section 2854 of the education law is amended by 11 adding a new paragraph (d-1) to read as follows: 12 (d-1) A charter school shall adopt rules, as it may deem necessary, 13 requiring students in grades seven to twelve to maintain a minimum grade 14 point average as a condition to participation in a school-sponsored 15 club, team or extracurricular organization that regularly meets to prac- 16 tice and/or compete interscholastically. 17 § 7. This act shall take effect immediately; provided however that the 18 amendments to section 2590-e of the education law made by section five 19 of this act shall survive the expiration and reversion of such section 20 as provided in section 34 of chapter 91 of the laws of 2002, as amended.
