STATE OF NEW YORK ________________________________________________________________________ 7465 2021-2022 Regular Sessions IN SENATE October 25, 2021 ___________ Introduced by Sen. COMRIE -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the general business law, in relation to prohibiting supply chain surcharges on consumer goods or services The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The general business law is amended by adding a new section 2 390-d to read as follows: 3 § 390-d. Supply chain surcharge prohibited. 1. For the purposes of 4 this section the term "supply chain surcharge" shall mean a fee imposed 5 on a good or service due to the lack of raw materials in the supply 6 chain or due to any other supply chain issue. 7 2. No seller in any sales transaction shall impose a supply chain 8 surcharge on a consumer. The display price for any good or service shall 9 include all costs associated with such good or service including but not 10 limited to taxes and fees. 11 3. Any seller who violates the provisions of this section shall be 12 guilty of a misdemeanor punishable by a fine not to exceed five hundred 13 dollars for each offense. 14 § 2.
