BALL -- read twice and ordered printed, and when printed to be committed to the Committee on Veterans, Homeland Securi- ty and Military Affairs AN ACT to amend the executive law, in relation to requiring certain municipalities to display the prisoner of war and missing in action flag THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Subdivision 1 of section 403-a of the executive law, as 2 amended by chapter 411 of the laws of 2005, is amended to read as 3 follows: 4 1. Every county outside the city of New York, city, town, and village 5 is encouraged to display the prisoner of war and missing in action flag 6 at the building housing its local legislative body on all days on which 7 the flag of the United States of America is displayed. EVERY COUNTY 8 OUTSIDE THE CITY OF NEW YORK, AND EVERY CITY, TOWN, AND VILLAGE SHALL 9 FLY AN OFFICIAL NATIONAL LEAGUE OF FAMILIES POW/MIA FLAG, AS DESIGNATED 10 BY SECTION 2 OF PUBLIC LAW 101-355 (36 U.S.C. 189) AT THE BUILDING HOUS- 11 ING ITS LOCAL LEGISLATIVE BODY IF A CONGRESSIONALLY CHARTERED VETERANS 12 ORGANIZATION INCLUDING ANY POST, CHAPTER, DETACHMENT UNIT, AUXILIARY 13 UNIT OR SOCIETY OF SUCH VETERANS ORGANIZATION HAS PROVIDED THE COUNTY, 14 CITY, TOWN, OR VILLAGE WITH SUCH FLAG AND, UPON SUCH MUNICIPALITY'S 15 REQUEST, ANY NECESSARY ATTACHMENTS OR FASTENERS REQUIRED TO ENABLE THE 16 FLAG TO BE VISIBLE TO THE PUBLIC, ON THE FOLLOWING DAYS: ARMED FORCES 17 DAY, THE THIRD SATURDAY IN MAY; MEMORIAL DAY, THE LAST MONDAY IN MAY; 18 FLAG DAY, JUNE 14; INDEPENDENCE DAY, JULY 4; NATIONAL POW/MIA RECOGNI- 19 TION DAY, THE THIRD FRIDAY IN SEPTEMBER EXCEPT IF SUCH DATE OF COMMEM- 20 ORATION CANNOT BE OBSERVED DUE TO A RELIGIOUS HOLIDAY, SUCH OBSERVANCES 21 SHALL THEN BE CONDUCTED ON THE SECOND FRIDAY IN SEPTEMBER AND VETERANS 22 DAY, NOVEMBER 11. 23 S 2.
