       Introduced  by  Sen.  RIVERA -- read twice and ordered printed, and when
         printed to be committed to the Committee on Health
       AN ACT to amend the public health law and the education law, in relation
         to establishing the high need primary care  medical  personnel  demon-
         stration program; and providing for the repeal of such provisions upon
         expiration thereof
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Short title. This act shall be known and may  be  cited  as
    2  the  "high  need  primary  care  medical personnel demonstration program
    3  act".
    4    S 2. Article 2 of the public health law is amended  by  adding  a  new
    5  title 6 to read as follows:
    6                                  TITLE VI
    7                        HIGH NEED PRIMARY CARE MEDICAL
    8                            PERSONNEL DEMONSTRATION
    9                                    PROGRAM
   10  SECTION 267. HIGH  NEED  PRIMARY  CARE  MEDICAL  PERSONNEL DEMONSTRATION
   11                 PROGRAM.
   12    S 267. HIGH NEED PRIMARY CARE MEDICAL PERSONNEL DEMONSTRATION PROGRAM.
   13  1. THE DEPARTMENT SHALL ESTABLISH  A  HIGH  NEED  PRIMARY  CARE  MEDICAL
   14  PERSONNEL  DEMONSTRATION  PROGRAM.  THE COMMISSIONER SHALL DESIGNATE SIX
   15  LOCATIONS AT WHICH SUCH PROGRAM SHALL BE CONDUCTED.
   16    (A) THE LOCATIONS OF THE DEMONSTRATION PROGRAM SHALL BE SELECTED BASED
   17  UPON THE FOLLOWING:
   18    (1) THE AMOUNT OF  PRIMARY  CARE  MEDICAL  SERVICES  PROVIDED  AT  THE
   19  LOCATION APPLYING FOR DESIGNATION;
   20    (2)  THE PERCENTAGE OF PATIENTS RECEIVING CARE THROUGH MEDICAL ASSIST-
   21  ANCE;
   22    (3) THE CAPACITY OF THE APPLICANT LOCATION TO HOST PHYSICIANS LICENSED
   23  PURSUANT TO SECTION SIXTY-FIVE HUNDRED TWENTY-FIVE OF THE EDUCATION LAW;
   24  AND
   25    (4) THE  BENEFIT  TO  THE  APPROPRIATE  HIGH  NEED  COMMUNITY  IN  THE
   26  PROVISION OF PRIMARY CARE MEDICAL PERSONNEL.

    1    (B) THE LOCATIONS OF THE DEMONSTRATION PROGRAM SHALL BE AS FOLLOWS:
    2    (1)  TWO  SHALL  BE  IN  RURAL AREAS, AS DEFINED IN SUBDIVISION ONE OF
    3  SECTION TWENTY-NINE HUNDRED FIFTY-ONE OF THIS CHAPTER;
    4    (2) TWO SHALL BE IN CITIES HAVING A POPULATION OF  ONE  HUNDRED  FIFTY
    5  THOUSAND OR MORE; AND
    6    (3) TWO SHALL BE IN CITIES HAVING A POPULATION OF ONE MILLION OR MORE.
    7    2.  ON  OR  BEFORE APRIL FIRST, TWO THOUSAND SIXTEEN, THE COMMISSIONER
    8  SHALL SUBMIT A REPORT TO THE GOVERNOR, THE TEMPORARY  PRESIDENT  OF  THE
    9  SENATE,  THE  SPEAKER OF THE ASSEMBLY, THE MINORITY LEADER OF THE SENATE
   10  AND THE MINORITY LEADER OF THE ASSEMBLY. SUCH REPORT SHALL INCLUDE,  BUT
   11  NOT  BE  LIMITED  TO,  A  STATISTICAL  ANALYSIS OF THE CHANGES IN HEALTH
   12  RESULTS FOR PATIENTS AT DEMONSTRATION PROGRAM LOCATIONS, AND THE  HOSPI-
   13  TALIZATION RATES, CHRONIC ILLNESSES AND VITAL STATISTICS THEREOF.
   14    3.  ALL  DEMONSTRATION  PROGRAM  LOCATIONS  SHALL  UTILIZE  PHYSICIANS
   15  LICENSED PURSUANT TO  SECTION  SIXTY-FIVE  HUNDRED  TWENTY-FIVE  OF  THE
   16  EDUCATION LAW.
   17    S  3.  Subdivisions  1  and 2 of section 6525 of the education law, as
   18  added by chapter 987 of the laws of 1971, paragraph 1 of  subdivision  1
   19  as  amended  by  chapter 133 of the laws of 1982, are amended to read as
   20  follows:
   21    1. Eligibility: The following persons shall be eligible for a  limited
   22  permit:
   23    (1)  A  person who fulfills all requirements for a license as a physi-
   24  cian except those relating to the examination and citizenship or  perma-
   25  nent residence in the United States;
   26    (2)  A  foreign  physician  who  holds a standard certificate from the
   27  educational council for foreign medical graduates or who has  passed  an
   28  examination  satisfactory to the state board for medicine and in accord-
   29  ance with the commissioner's regulations; [or]
   30    (3) A foreign physician or a foreign intern who is in this country  on
   31  a  non-immigration  visa for the continuation of medical study, pursuant
   32  to the exchange student program  of  the  United  States  department  of
   33  state[.]; OR
   34    (4)  A  PERSON  WHO  GRADUATES  FROM  A  REGENTS, LIAISON COMMITTEE ON
   35  MEDICAL EDUCATION OR AMERICAN OSTEOPATHIC ASSOCIATION ACCREDITED MEDICAL
   36  PROGRAM, OR A PERSON WHO GRADUATES FROM ANY OTHER  MEDICAL  PROGRAM  WHO
   37  HAS  PASSED ELEVEN REQUISITE STEPS OR PARTS OF THE UNITED STATES MEDICAL
   38  LICENSING EXAMINATION OR NATIONAL BOARD OF OSTEOPATHIC MEDICAL EXAMINERS
   39  EXAMINATION, WHERE SUCH A PERSON PRACTICES  AT  A  MEDICAL  FACILITY  OR
   40  PRACTICE  DESIGNATED BY THE DEPARTMENT OF HEALTH PURSUANT TO SECTION TWO
   41  HUNDRED SIXTY-SEVEN OF THE PUBLIC HEALTH LAW.
   42    2. Limit of practice. A permittee  shall  be  authorized  to  practice
   43  medicine  only under the supervision of a licensed physician and only in
   44  a public, voluntary[,] or proprietary hospital, OR PURSUANT  TO  SECTION
   45  TWO HUNDRED SIXTY-SEVEN OF THE PUBLIC HEALTH LAW.
   46    S  4.  This  act shall take effect on the ninetieth day after it shall
   47  have become a law, and shall expire and be deemed repealed July 1, 2016.
