SIMOTAS -- read once and referred to the Committee on Corporations, Authorities and Commissions AN ACT to amend the public authorities law, in relation to the composi- tion of the metropolitan transportation authority The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subparagraph 1 of paragraph (a) of subdivision 1 of section 2 1263 of the public authorities law, as amended by section 1 of part E of 3 chapter 39 of the laws of 2019, is amended to read as follows: 4 (1) There is hereby created the "metropolitan transportation authori- 5 ty." The authority shall be a body corporate and politic constituting a 6 public benefit corporation. The authority shall consist of a chairman, 7 [sixteen] twenty-one other voting members, and two non-voting and four 8 alternate non-voting members, as described in subparagraph two of this 9 paragraph appointed by the governor by and with the advice and consent 10 of the senate; provided, however, that there shall be one voting member 11 appointed by each of the five borough presidents in the city of New 12 York. Any member appointed to a term commencing on or after June thirti- 13 eth, two thousand nine shall have experience in one or more of the 14 following areas: transportation, public administration, business manage- 15 ment, finance, accounting, law, engineering, land use, urban and 16 regional planning, management of large capital projects, labor 17 relations, or have experience in some other area of activity central to 18 the mission of the authority. [Four] There shall be one voting member 19 appointed by the borough president of Staten Island, who shall be, at 20 the time of appointment, a resident of Staten Island. There shall be one 21 voting member appointed by the borough president of Manhattan, who shall 22 be, at the time of appointment, a resident of Manhattan. There shall be 23 one voting member appointed by the borough president of the Bronx, who 24 shall be, at the time of appointment, a resident of the Bronx. LBD14768-02-0S. 7585 2 A. 9629 1 shall be one voting member appointed by the borough president of Brook- 2 lyn, who shall be, at the time of appointment, a resident of Brooklyn. 3 There shall be one voting member appointed by the borough president of 4 Queens, who shall be, at the time of appointment, a resident of Queens. 5 Two of the [sixteen] twenty-one voting members other than the chairman 6 shall be appointed on the written recommendation of the mayor of the 7 city of New York; and each of seven other voting members other than the 8 chairman shall be appointed after selection from a written list of three 9 recommendations from the chief executive officer of the county in which 10 the particular member is required to reside pursuant to the provisions 11 of this subdivision. Of the members appointed on recommendation of the 12 chief executive officer of a county, one such member shall be, at the 13 time of appointment, a resident of the county of Nassau, one a resident 14 of the county of Suffolk, one a resident of the county of Westchester, 15 one a resident of the county of Dutchess, one a resident of the county 16 of Orange, one a resident of the county of Putnam and one a resident of 17 the county of Rockland, provided that the term of any member who is a 18 resident of a county that has withdrawn from the metropolitan commuter 19 transportation district pursuant to section twelve hundred 20 seventy-nine-b of this title shall terminate upon the effective date of 21 such county's withdrawal from such district. Of the [five] seven voting 22 members, other than the chairman, appointed by the governor without 23 recommendation from any other person, three shall be, at the time of 24 appointment, residents of the city of New York and two shall be, at the 25 time of appointment, residents of such city or of any of the aforemen- 26 tioned counties in the metropolitan commuter transportation district. 27 Provided however, notwithstanding the foregoing residency requirement, 28 one of the [five] seven voting members appointed by the governor without 29 recommendation from any other person, other than the chairman, may be 30 the director of the New York state division of the budget, and provided 31 further that, in the event of such appointment, the budget director's 32 membership in the authority shall be deemed ex-officio. The chairman and 33 each of the members shall be appointed for a term of six years, provided 34 however, that the chairman first appointed shall serve for a term ending 35 June thirtieth, nineteen hundred eighty-one, provided that thirty days 36 after the effective date of [the] chapter twenty-five of the laws of two 37 thousand nine [which amended this subparagraph], the term of the chair- 38 man shall expire; provided, further, that such chairman may continue to 39 discharge the duties of his or her office until the position of chairman 40 is filled by appointment by the governor upon the advice and consent of 41 the senate and the term of such new chairman shall terminate June thir- 42 tieth, two thousand fifteen. The [sixteen] twenty-one other members 43 first appointed shall serve for the following terms: The members from 44 the counties of Nassau and Westchester shall each serve for a term 45 ending June thirtieth, nineteen hundred eighty-five; the members from 46 the county of Suffolk and from the counties of Dutchess, Orange, Putnam 47 and Rockland shall each serve for a term ending June thirtieth, nineteen 48 hundred ninety-two; two of the members appointed on recommendation of 49 the mayor of the city of New York shall each serve for a term ending 50 June thirtieth, nineteen hundred eighty-four and, two shall each serve 51 for a term ending June thirtieth, nineteen hundred eighty-one; two of 52 the members appointed by the governor without the recommendation of any 53 other person shall each serve for a term ending June thirtieth, nineteen 54 hundred eighty-two, two shall each serve for a term ending June thirti- 55 eth, nineteen hundred eighty and one shall serve for a term ending June 56 thirtieth, nineteen hundred eighty-five; the members appointed by theS. 7585 3 A. 9629 1 borough presidents of the five boroughs of the city of New York shall 2 serve for a term ending June thirtieth, two thousand twenty-six. The two 3 non-voting and four alternate non-voting members shall serve until Janu- 4 ary first, two thousand one. The members from the counties of Dutchess, 5 Orange, Putnam and Rockland shall cast one collective vote. 6 § 2. Paragraph (a) of subdivision 1 of section 1263 of the public 7 authorities law, as amended by section 2 of part E of chapter 39 of the 8 laws of 2019, is amended to read as follows: 9 (a) There is hereby created the "metropolitan transportation authori- 10 ty." Two of the [sixteen] twenty-one members 33 other than the chairman shall be appointed on the written recommendation 34 of the mayor of the city of New York; and each of seven other members 35 other than the chairman shall be appointed after selection from a writ- 36 ten list of three recommendations from the chief executive officer of 37 the county in which the particular member is required to reside pursuant 38 to the provisions of this subdivision. Of the members appointed on 39 recommendation of the chief executive officer of a county, one such 40 member shall be, at the time of appointment, a resident of the county of 41 Nassau; one a resident of the county of Suffolk; one a resident of the 42 county of Westchester; and one a resident of the county of Dutchess, one 43 a resident of the county of Orange, one a resident of the county of 44 Putnam and one a resident of the county of Rockland, provided that the 45 term of any member who is a resident of a county that has withdrawn from 46 the metropolitan commuter transportation district pursuant to section 47 twelve hundred seventy-nine-b of this title shall terminate upon the 48 effective date of such county's withdrawal from such district. Of the 49 [five] seven members, other than the chairman, appointed by the governor 50 without recommendation from any other person, three shall be, at the 51 time of appointment, residents of the city of New York and two shall be, 52 at the time of appointment, residents of such city or of any of the 53 aforementioned counties in the metropolitan commuter transportation 54 district. Provided however, notwithstanding the foregoing residency 55 requirement, one of the [five] seven voting members appointed by the 56 governor without recommendation from any other person, other than theS. 7585 4 A. 9629 1 chairman, may be the director of the New York state division of the 2 budget, and provided further that, in the event of such appointment, the 3 budget director's membership in the authority shall be deemed ex-offi- 4 cio. The chairman and each of the members shall be appointed for a term 5 of six years, provided however, that the chairman first appointed shall 6 serve for a term ending June thirtieth, nineteen hundred eighty-one, 7 provided that thirty days after the effective date of [the] chapter 8 twenty-five of the laws of two thousand nine [which amended this para-9graph], the term of the chairman shall expire; provided, further, that 10 such chairman may continue to discharge the duties of his office until 11 the position of chairman is filled by appointment by the governor upon 12 the advice and consent of the senate and the term of such new chairman 13 shall terminate June thirtieth, two thousand fifteen. The [sixteen] 14 twenty-one other members first appointed shall serve for the following 15 terms: The members from the counties of Nassau and Westchester shall 16 each serve for a term ending June thirtieth, nineteen hundred eighty- 17 five; the members from the county of Suffolk and from the counties of 18 Dutchess, Orange, Putnam and Rockland shall each serve for a term ending 19 June thirtieth, nineteen hundred ninety-two; two of the members 20 appointed on recommendation of the mayor of the city of New York shall 21 each serve for a term ending June thirtieth, nineteen hundred eighty- 22 four and, two shall each serve for a term ending June thirtieth, nine- 23 teen hundred eighty-one; two of the members appointed by the governor 24 without the recommendation of any other person shall each serve for a 25 term ending June thirtieth, nineteen hundred eighty-two, two shall each 26 serve for a term ending June thirtieth, nineteen hundred eighty and one 27 shall serve for a term ending June thirtieth, nineteen hundred eighty- 28 five; the members appointed by the borough presidents of the five 29 boroughs of the city of New York shall serve for a term ending June 30 thirtieth, two thousand twenty-six. The members from the counties of 31 Dutchess, Orange, Putnam and Rockland shall cast one collective vote. 32 § 3. This act shall take effect immediately, provided that the amend- 33 ments to paragraph (a) of subdivision 1 of section 1263 of the public 34 authorities law made by section one of this act shall be subject to the 35 expiration and reversion of such paragraph pursuant to section 3 of 36 chapter 549 of the laws of 1994, as amended, when upon such date the 37 provisions of section two of this act shall take effect.
