        Introduced  by Sen. KAVANAGH -- read twice and ordered printed, and when
          printed to be committed to the Committee on Environmental Conservation

        AN ACT to amend the  environmental  conservation  law,  in  relation  to
          requiring  single-use  beverage  containers  to  be  manufactured with
          seventy-five percent recycled materials

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1.  Section  27-1011 of the environmental conservation law is
     2  amended by adding a new subdivision 4 to read as follows:
     3    4. a. No deposit initiator, distributor or dealer shall sell or  offer
     4  for  sale,  at wholesale or retail in this state, any single-use plastic
     5  beverage container that is comprised of less than  seventy-five  percent
     6  recycled materials.
     7    b. As used in this section, the following terms shall have the follow-
     8  ing meanings:
     9    (i)  "Single-use plastic beverage container" shall mean any individual
    10  bottle, can, jar, carton or other container that is comprised wholly  or
    11  in  large  part  of  plastic and is intended to be disposed of after one
    12  use.
    13    (ii) "Recycled materials" shall mean any product which has been  manu-
    14  factured from secondary materials, as defined in section 27-0401 of this
    15  article.
    16    § 2. This act shall take effect January 1, 2025.
