JACKSON -- read twice and ordered printed, and when printed to be committed to the Committee on Civil Service and Pensions -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to amend the civil service law, in relation to establishing time- line standards for candidates to take competitive examinations The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 54 of the civil service law, as amended by chapter 2 278 of the laws of 1994, is amended to read as follows: 3 § 54. Age and educational requirements. 1. Notwithstanding any 4 provision of law to the contrary, except as herein provided, neither the 5 state civil service department nor the state civil service commission, 6 nor any municipal civil service commission shall prohibit, prevent, 7 disqualify, or discriminate against, any person who is physically and 8 mentally qualified, from participating in a civil service examination or 9 from qualifying for a position in the classified civil service, or 10 penalize any such person in a final rating by reason of his or her age; 11 and any such rule, requirement, resolution, regulation or penalization 12 shall be void. Nothing herein contained, however, shall prevent the 13 adoption of reasonable minimum or maximum age requirements for open 14 competitive examinations for positions where it is determined by the 15 department and approved by the commission that such age requirements 16 would be reasonable minimum qualification for such position. Minimum age 17 requirements shall in no case prohibit an applicant who is within [six] 18 twelve months of the minimum age requirement from taking any competitive 19 examination. Nothing herein contained shall be construed to prohibit the 20 disqualification, on account of age, of any applicant for a position who 21 has reached the mandatory retirement age applicable by law to such posi- 22 tion. 23 2. Minimum education requirements shall in no case prohibit an appli- 24 cant who is within twelve months of obtaining the minimum education 25 requirements from taking any competitive examination. 26 § 2.
