        AN ACT to amend chapter 420 of the laws of 2013 relating to  authorizing
          the  town  of  Orangetown,  county  of Rockland, to discontinue use of
          certain lands as park lands and sell such lands, and dedicate  certain
          other lands as park lands, in relation to making technical corrections
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
     1    Section 1. Section 4 of chapter 420 of the laws of  2013  relating  to
     2  authorizing  the  town of Orangetown, county of Rockland, to discontinue
     3  use of certain lands as park lands and sell  such  lands,  and  dedicate
     4  certain other lands as park lands, is amended to read as follows:
     5    §  4.  Prior  to  the  discontinuance  and alienation of the park land
     6  described in section three of this act, and subject to the  requirements
     7  of  section  two of this act, the town of Orangetown, acting through its
     8  town board, shall dedicate lands from the  description  of  lands  below
     9  that the town of Orangetown has never used for public open space or park
    10  purposes,  are  not  lands under water, and are at least thirty acres of
    11  land that include [all] land adjacent to a body of water known  as  Lake
    12  Tappan[,  and  that such lands form one contiguous park]. Such lands are
    13  located in an area bounded and described as follows:
    14    ALL that certain plot, piece or parcel  of  land  situate,  lying  and
    15  being  in  the  Town  of Orangetown, County of Rockland and State of New
    16  York, being more particularly bounded and described as follows:

    52    § 2. Section 2 of chapter 420 of the laws of 2013 relating to  author-
    53  izing  the town of Orangetown, county of Rockland, to discontinue use of
    54  certain lands as park lands and sell such lands,  and  dedicate  certain
    55  other lands as park lands, is amended to read as follows:

     1    § 2. The authorization contained in section one of this act shall take
     2  effect  only  upon the condition that the town of Orangetown shall dedi-
     3  cate lands from the lands described in section four of this act as addi-
     4  tional park lands of the town, provided that the town of Orangetown  has
     5  never  used  such  lands for public open space or park purposes, are not
     6  lands under water, are improved such that the  lands  with  improvements
     7  are  of  equal  or  greater fair market value than the value of the park
     8  lands being alienated by this act, and are at least thirty acres of land
     9  that include [all] land adjacent to a body of  water  within  the  lands
    10  described  in  section  four of this act known as Lake Tappan[, and that
    11  such lands form one contiguous park]. Such improvements  shall  include,
    12  but  not  be  limited  to, a walking and/or bike path, and public access
    13  points to Lake Tappan.  The authorization contained in  section  one  of
    14  this  act  shall also only be effective on the condition that the Office
    15  of Parks, Recreation and Historic  Preservation  has  agreed  that  such
    16  additional  lands are suitable replacement park lands. In the event that
    17  such lands and improvements are not of  equal  or  greater  fair  market
    18  value to the park lands being alienated by this act, the town of Orange-
    19  town  shall  dedicate  the  difference in such fair market value for the
    20  acquisition or designation of additional town park lands that  the  town
    21  of  Orangetown has never used for public open space or park purposes, or
    22  for capital improvements to existing town park and recreational  facili-
    23  ties.
    24    § 3. This act shall take effect immediately.
