STATE OF NEW YORK ________________________________________________________________________ 8353 IN SENATE January 19, 2024 ___________ Introduced by Sen. MAY -- read twice and ordered printed, and when printed to be committed to the Committee on Disabilities AN ACT to amend the education law, in relation to requiring funding for special education services and programs for preschool children with disabilities to cover full-day joint classroom instruction The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 4410 of the education law is amended by adding a 2 new subdivision 14 to read as follows: 3 14. Full-day special education funding. Any school district that 4 receives funds for special education services or programs for preschool 5 children with disabilities pursuant to this section, and that receives 6 funds for federal and/or statewide universal prekindergarten programs 7 pursuant to section thirty-six hundred two-e and/or section thirty-six 8 hundred two-ee of this chapter, shall be mandated to operate joint 9 classroom instruction for preschool children who require special 10 services or programs under this section, and other children for the same 11 number of hours each day. The department shall promulgate any rules 12 and/or regulations necessary to implement the provisions of this subdi- 13 vision. 14 § 2. This act shall take effect immediately.
