STATE OF NEW YORK ________________________________________________________________________ 8971 IN SENATE May 3, 2022 ___________ Introduced by Sen. JORDAN -- read twice and ordered printed, and when printed to be committed to the Committee on Investigations and Govern- ment Operations AN ACT to amend the public officers law, in relation to providing for a waiver of the residency requirement for the city attorney in the city of Saratoga Springs, Saratoga county The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 3 of the public officers law is amended by adding a 2 new subdivision 72 to read as follows: 3 72. In the city of Saratoga Springs, in the county of Saratoga, the 4 provisions of this section requiring a person to be a resident of the 5 political subdivision or municipal corporation of the state for which 6 such person shall be chosen or within which the person's official func- 7 tions are required to be exercised, shall not prevent a person from 8 holding the office of city attorney of the city of Saratoga Springs, 9 provided that such person resides in Saratoga county or an adjoining 10 county within the state of New York; provided, however that any 11 person performing such functions or holding such office of the city 12 attorney in any other city shall be a resident of such city unless 13 otherwise provided by law. 14 § 2.
