It is an editor's brief statement of the essential features of the measure as introduced. Removes mandatory requirement to set aside one percent of amount of contract to construct or alter state building for acquiring art and instead permits contracting agency to set aside amount to acquire art. Becomes operative 91 days after effective date of Act. Declares emergency, effective on passage. A BILL FOR AN ACT Relating to acquiring art for state buildings; creating new provisions; amending ORS 276.080; and declaring an emergency. Be It Enacted by the People of the State of Oregon: SECTION 1. ORS 276.080 is amended to read: 276.080. { - (1) All appropriations for the construction or alteration of any state building shall be considered to contain an appropriation of one percent of the amount thereof for the acquisition of works of art which may be an integral part of the building, attached thereto or capable of display in other state buildings. - } { - (2) When it would not be appropriate to place works of art in a given structure, the funds authorized in subsection (1) of this section shall be expended to acquire works of art for placement in other buildings under the control of the contracting agency. - } { + A contracting agency that awards a contract to construct or alter a state building may set aside a portion of the contract price to acquire works of art in accordance with a determination made under ORS 276.090. The works of art may be an integral part of the state building, attached to the state building or capable of display in another state building. + } SECTION 2. { + The amendments to ORS 276.080 by section 1 of this 2011 Act apply to a contract that a contracting agency first advertises or otherwise solicits on or after the operative date set forth in section 3 of this 2011 Act or, if the contracting agency does not advertise or solicit the contract, to a contract that the contracting agency enters into on or after the operative date set forth in section 3 of this 2011 Act. + } SECTION 3. { + (1) The amendments to ORS 276.080 by section 1 of this 2011 Act become operative 91 days after the effective date of this 2011 Act. (2) The Director of the Oregon Department of Administrative Services, the Attorney General or a contracting agency that adopts rules under ORS 279A.065 may take any action before the operative date set forth in subsection (1) of this section that is necessary to enable the director, the Attorney General or the contracting agency to exercise, on and after the operative date set forth in subsection (1) of this section, all of the duties, functions and powers conferred on the director, the Attorney General or the contracting agency by the amendments to ORS 276.080 by section 1 of this 2011 Act. + } SECTION 4. { + This 2011 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 2011 Act takes effect on its passage. + } ----------
