SUMMARY The following summary is not prepared by the sponsors of the measure and is not a part of the body thereof subject to consideration by the Legislative Assembly. It is an editor's brief statement of the essential features of the measure as introduced. Prohibits fishing for salmon within one-half mile of entrance to any bay or estuary in this state. Provides exceptions. Punishes by maximum of 30 days' imprisonment, $1,250 fine, or both. Declares emergency, effective on passage. A BILL FOR AN ACT Relating to fishing; and declaring an emergency. Be It Enacted by the People of the State of Oregon: SECTION 1. { + (1) Notwithstanding any other provision of law, and except for the period from July 1 to October 31 of each calendar year, a person may not fish for salmon within one-half mile of the entrance to any bay or estuary in this state. (2) The provisions of this section do not apply to the Columbia River. (3) The State Fish and Wildlife Commission may adopt rules to implement this section. (4) Violation of this section, or any rule adopted under this section, is a Class C misdemeanor. + } SECTION 2. { + (1) Except as provided in subsection (2) of this section, section 1 of this 2013 Act becomes operative on January 1, 2014. (2) The State Fish and Wildlife Commission may adopt rules or take any other action before the operative date specified in subsection (1) of this section that is necessary to implement, on or after the operative date specified in subsection (1) of this section, section 1 of this 2013 Act. + } SECTION 3. { + Section 1 of this 2013 Act applies to conduct occurring on or after the operative date specified in section 2 of this 2013 Act. + } SECTION 4. { + This 2013 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 2013 Act takes effect on its passage. + } ----------
