Applies discovery provisions to criminal prosecutions conducted in courts that have not become courts of record. Declares emergency, effective on passage. A BILL FOR AN ACT Relating to discovery; creating new provisions; amending ORS 135.805; and declaring an emergency. Be It Enacted by the People of the State of Oregon: SECTION 1. ORS 135.805 is amended to read: 135.805. (1) The provisions of ORS 135.805 to 135.873 are applicable to all criminal prosecutions { - in which the charging instrument has been brought in a court of record - } . (2) As used in ORS 135.805 to 135.873, 'disclose' means to afford the adverse party an opportunity to inspect or copy the material. SECTION 2. { + The amendments to ORS 135.805 by section 1 of this 2011 Act apply to criminal prosecutions commenced on or after the effective date of this 2011 Act. + } SECTION 3. { + This 2011 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 2011 Act takes effect on its passage. + } ----------
