It is an editor's brief statement of the essential features of the measure as introduced. Extends applicability of law that requires school districts to offer half-day kindergarten and allows school districts and public charter schools to offer supplemental kindergarten. Requires school district to offer half-day kindergarten, authorizes school districts to offer full-day kindergarten and authorizes public charter schools to offer either half-day or full-day kindergarten, beginning with 2017-2018 school year. Specifies that aggregate days membership of kindergarten students be calculated on basis of either half-time or full-time program, whichever school offers, beginning with State School Fund distributions made for 2017-2018 school year. Extends by two years date by which process for determining child's readiness for kindergarten is made available to school districts for implementation. Declares emergency, effective on passage. A BILL FOR AN ACT Relating to kindergarten; amending sections 2 and 3, chapter 40, Oregon Laws 2008, sections 6, 10 and 14, chapter 704, Oregon Laws 2011, and section 14, chapter 37, Oregon Laws 2012; and declaring an emergency. Be It Enacted by the People of the State of Oregon: SECTION 1. Section 2, chapter 40, Oregon Laws 2008, as amended by section 1, chapter 388, Oregon Laws 2009, and section 1, chapter 704, Oregon Laws 2011, is amended to read: { + Sec. 2. + } Section 1, chapter 40, Oregon Laws 2008, applies to the 2007-2008, 2008-2009, 2009-2010, 2010-2011, 2011-2012, 2012-2013, 2013-2014 { + , + } { - and - } 2014-2015 { + , 2015-2016 and 2016-2017 + } school years. SECTION 2. Section 3, chapter 40, Oregon Laws 2008, as amended by section 2, chapter 388, Oregon Laws 2009, and section 2, chapter 704, Oregon Laws 2011, is amended to read: { + Sec. 3. + } Section 1, chapter 40, Oregon Laws 2008, is repealed on June 30, { - 2015 - } { + 2017 + }. SECTION 3. Section 6, chapter 704, Oregon Laws 2011, is amended to read: { + Sec. 6. + } The amendments to ORS 327.106, 336.095 and 339.141 by sections 3 to 5 { - of this 2011 Act - } { + , chapter 704, Oregon Laws 2011, + } first apply to the { - 2015-2016 - } { + 2017-2018 + } school year. SECTION 4. Section 10, chapter 704, Oregon Laws 2011, is amended to read: { + Sec. 10. + } The amendments to ORS 327.006, 327.077 and 327.297 by sections 7 to 9 { - of this 2011 Act - } { + , chapter 704, Oregon Laws 2011, + } apply to State School Fund distributions commencing with the { - 2015-2016 - } { + 2017-2018 + } distributions. SECTION 5. Section 14, chapter 704, Oregon Laws 2011, is amended to read: { + Sec. 14. + } The amendments to ORS 327.006, 327.077, 327.106, 327.297, 330.101, 336.092, 336.095 and 339.141 by sections 3 to 5, 7 to 9, 11 and 12 { - of this 2011 Act - } { + , chapter 704, Oregon Laws 2011, + } and the repeal of ORS 327.082 by section 13 { - of this 2011 Act - } { + , chapter 704, Oregon Laws 2011, + } become operative July 1, { - 2015 - } { + 2017 + }. SECTION 6. Section 14, chapter 37, Oregon Laws 2012, is amended to read: { + Sec. 14. + } (1) The Early Learning Council established by section 4, chapter 519, Oregon Laws 2011, and the Department of Education shall jointly develop a process that allows for an assessment of children to determine their readiness for kindergarten. The development of the process must include the input of kindergarten teachers prior to implementation as described in subsection (2) of this section. (2) By November 1, 2012, the process described in subsection (1) of this section must be made available to school districts that have been selected to be part of a pilot program for the implementation of the process. The council and department shall select the participating school districts from school districts that volunteer to be part of the pilot program and in a manner that achieves the greatest possible diversity of school districts across this state. (3) By November 1, { - 2013 - } { + 2015 + }, the process described in subsection (1) of this section must be made available to all school districts for implementation. { + (4) Except for a school district participating in the pilot program described in subsection (2) of this section, a school district is not required to implement any assessment system for determining a child's readiness for kindergarten until after the process described in subsection (1) of this section is available to the school district as provided by subsection (3) of this section. + } SECTION 7. { + This 2013 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 2013 Act takes effect on its passage. + } ----------
