LC 4028 Senate Bill 856 Sponsored by Senator FERRIOLI, Representative BENTZ (at the request of Judge Grasty) SUMMARY The following summary is not prepared by the sponsors of the measure and is not a part of the body thereof subject to consideration by the Legislative Assembly. It is an editor's brief statement of the essential features of the measure as introduced. Directs Oregon Department of Administrative Services to sell Timms Hamby Computer Archive Center to Harney County for consideration of $1. Requires Harney County to transfer annually to State Treasurer 50 percent of profits attributable to center until amount transferred equals $50,000, or, if earlier, January 1, 2024. Declares emergency, effective on passage. A BILL FOR AN ACT Relating to local finance; and declaring an emergency. Be It Enacted by the People of the State of Oregon: SECTION 1. { + The Legislative Assembly finds that: (1) The Timms Hamby Computer Archive Center located in Burns, Oregon, is underutilized. (2) The purchase and commercial exploitation of the center by Harney County will better enable the county to finance the operations of the county government. + } SECTION 2. { + (1) The Oregon Department of Administrative Services shall sell the Timms Hamby Computer Archive Center located in Burns, Oregon, to Harney County for the consideration of $1. (2) The sale and transfer of the center must be completed on or before the date that is 90 days after the effective date of this 2013 Act. + } SECTION 3. { + Sections 1 and 2 of this 2013 Act are repealed on January 2, 2015. + } SECTION 4. { + (1) Not later than one month after the end of each fiscal year, the governing body of Harney County shall transfer an amount equal to 50 percent of the profits attributable to the Timms Hamby Computer Archive Center during the fiscal year just ended to the State Treasurer to help repay certificates of participation issued with respect to the center. (2) The county's obligation to make the transfers required under this section shall continue until: (a) The total amount transferred equals $50,000; or (b) January 1, 2024, if the total amount transferred does not equal $50,000 by that date. (3) For purposes of this section, 'profits' means income minus costs paid by the county. + } SECTION 5. { + (1) Section 4 of this 2013 Act becomes operative on the date on which the sale and transfer of the Timms Hamby Computer Archive Center to Harney County pursuant to section 2 of this 2013 Act is completed. (2)(a) If section 4 of this 2013 Act becomes operative pursuant to subsection (1) of this section, section 4 of this 2013 Act is repealed on January 2, 2026. (b) If section 4 of this 2013 Act does not become operative pursuant to subsection (1) of this section, section 4 of this 2013 Act is repealed on January 2, 2015. + } SECTION 6. { + This 2013 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 2013 Act takes effect on its passage. + } ----------
