Summary

As introduced, includes fentanyl, carfentanil, remifentanil, alfentanil, thiafentanil, or certain fentanyl derivatives or analogues as a chemical warfare agent when intended for use in a war or other attack to cause disease or death in humans, animals, or plants; categorizes fentanyl as a weapon of mass destruction, thereby making it a Class B felony for any person, without lawful authority, to possess, develop, manufacture, produce, transfer, acquire, weaponize, or retain fentanyl, carfentanil, remifentanil, alfentanil, thiafentanil, or certain fentanyl derivatives or analogues. - Amends TCA Title 39.
