Amend CSHB 3286 (house committee printing) as follows:

(1)  On page 1, strike lines 9 through 11.

(2)  On page 1, strike lines 13 through 16 and replace with "The Commission shall adopt rules allowing exceptions to the preferred drug list if:"

(3)  On page 1, line 17, between "(1)" and "the" add "the drug required under"

(4)  On page 1, line 17, after "drug" add "list"

(5)  On page 2, strike lines 6 through 10 and renumber subsequent subdivisions accordingly.

(6)  On page 3, before line 1, add the following:

(b)  An exception provided under this section does not subject the Medicaid managed care plan to liquidated damages for failing to comply with the preferred drug list.

(7)  On page 3, strike lines 1 through 11.
