BACKGROUND AND PURPOSE

Texas requires a lifetime registration to the Sex Offender Registry for adults convicted of trafficking a child, compelling prostitution of a child, and trafficking an adult. Those convicted of compelling prostitution of an adult must register for only ten years. Other individuals who fall under the ten-year rule include accomplices to trafficking and those convicted of solicitation. H.B. 1136 seeks to update state law to add compelling prostitution to the list offenses that require an individual to be placed on the Sex Offender Registry for life.

CRIMINAL JUSTICE IMPACT

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS

H.B. 1136 amends the Code of Criminal Procedure to include the offense of compelling prostitution by force, threat, coercion, or fraud among the offenses for which the duty to register as a sex offender following an applicable conviction or adjudication for the offense does not expire. The bill's provisions apply only to a conviction or adjudication for an offense committed on or after the bill's effective date. The bill provides for the continuation of the law in effect before the bill's effective date for purposes of an offense, or any element thereof, that occurred before that date.

September 1, 2023.
