A BILL TO BE ENTITLED
 
AN ACT
  relating to the purchase of replacement personal computers by state
  agencies.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter A, Chapter 2157, Government Code, is
  amended by adding Section 2157.007 to read as follows:
         Sec. 2157.007.  PURCHASE OF PERSONAL COMPUTERS BY STATE
  AGENCY.  (a)  In this section:
               (1)  "Personal computer" means a laptop, desktop, tower
  computer system, or other personal computer that contains a central
  processing unit, random access memory, and a storage device.
               (2)  "State agency" does not include an institution of
  higher education as defined by Section 61.003, Education Code.
         (b)  Except as provided by Subsection (c), a state agency may
  not purchase a new personal computer to replace an existing
  personal computer of the agency before the fourth anniversary of
  the date the existing personal computer was purchased.
         (c)  A state agency may purchase a new personal computer to
  replace an existing personal computer of the agency before the
  fourth anniversary of the date the existing personal computer was
  purchased if the agency determines that the purchase is to be made
  under emergency circumstances as established by the comptroller.
         (d)  The comptroller shall adopt rules establishing
  circumstances under which a state agency may make an emergency
  purchase under Subsection (c).
         SECTION 2.  (a)  This Act applies to a purchase made on or
  after August 1, 2012.  A purchase made before August 1, 2012, is
  governed by the law as it existed immediately before the effective
  date of this Act, and that law is continued in effect for that
  purpose.
         (b)  The comptroller shall adopt rules required by Section
  2157.007(d), Government Code, as added by this Act, not later than
  March 1, 2012.
         SECTION 3.  This Act takes effect September 1, 2011.
