relating to the purchase of replacement personal computers by state | ||
agencies. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter A, Chapter 2157, Government Code, is | ||
amended by adding Section 2157.007 to read as follows: | ||
Sec. 2157.007. PURCHASE OF PERSONAL COMPUTERS BY STATE | ||
AGENCY. (a) In this section: | ||
(1) "Personal computer" means a laptop, desktop, tower | ||
computer system, or other personal computer that contains a central | ||
processing unit, random access memory, and a storage device. | ||
(2) "State agency" does not include an institution of | ||
higher education as defined by Section 61.003, Education Code. | ||
(b) Except as provided by Subsection (c), a state agency may | ||
not purchase a new personal computer to replace an existing | ||
personal computer of the agency before the fourth anniversary of | ||
the date the existing personal computer was purchased. | ||
(c) A state agency may purchase a new personal computer to | ||
replace an existing personal computer of the agency before the | ||
fourth anniversary of the date the existing personal computer was | ||
purchased if the agency determines that the purchase is to be made | ||
under emergency circumstances as established by the comptroller. | ||
(d) The comptroller shall adopt rules establishing | ||
circumstances under which a state agency may make an emergency | ||
purchase under Subsection (c). | ||
SECTION 2. (a) This Act applies to a purchase made on or | ||
after August 1, 2012. A purchase made before August 1, 2012, is | ||
governed by the law as it existed immediately before the effective | ||
date of this Act, and that law is continued in effect for that | ||
purpose. | ||
(b) The comptroller shall adopt rules required by Section | ||
2157.007(d), Government Code, as added by this Act, not later than | ||
March 1, 2012. | ||
SECTION 3. This Act takes effect September 1, 2011. |
