relating to the punishment by confinement for contempt of court for | ||
failure to obey a court order related to truancy. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 25.094, Education Code, is amended by | ||
adding Subsection (h) to read as follows: | ||
(h) Notwithstanding any other law, an individual found in | ||
contempt of court, or adjudicated to have engaged in delinquent | ||
conduct that would constitute contempt of court, for failure to | ||
obey a court order related to an offense under Subsection (a) may | ||
not be punished for the contempt or delinquent conduct by | ||
confinement in jail or detention in a juvenile detention facility. | ||
SECTION 2. The change in law made by this Act applies only | ||
to conduct that would constitute contempt of court that occurs on or | ||
after the effective date of this Act. Conduct that would constitute | ||
contempt of court that occurred before the effective date of this | ||
Act is governed by the law in effect on the date the conduct | ||
occurred, and the former law is continued in effect for that | ||
purpose. For purposes of this section, conduct occurred before the | ||
effective date of this Act if any element of the conduct occurred | ||
before that date. | ||
SECTION 3. This Act takes effect September 1, 2015. |
