requirements applicable to the levying of a county tax. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Sections 81.006(a) and (c), Local Government | ||
Code, are amended to read as follows: | ||
(a) Three members of the commissioners court constitute a | ||
quorum for conducting county business [ |
||
(c) A county may not levy a tax unless at least four [ |
||
members of the court vote in favor of the levy. | ||
SECTION 2. Section 81.006(b), Local Government Code, is | ||
repealed. | ||
SECTION 3. The changes in law made by this Act apply only to | ||
a vote by a commissioners court on the question of levying a tax | ||
taken on or after the effective date of this Act. A vote by a | ||
commissioners court on the question of levying a tax taken before | ||
the effective date of this Act is governed by the law in effect when | ||
the vote was taken, and the former law is continued in effect for | ||
that purpose. | ||
SECTION 4. This Act takes effect September 1, 2023. |
