| relating to funding for open-enrollment charter schools. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Sections 12.106(a-1) and (a-2), Education Code, | ||
| are amended to read as follows: | ||
| (a-1) In determining funding for an open-enrollment charter | ||
| school under Subsection (a): | ||
| (1) adjustments under Sections 42.102, 42.104, and | ||
| 42.105 are based on the lesser of: | ||
| (A) the average adjustment for the state; or | ||
| (B) the adjustment for the school district within | ||
| whose boundaries the charter holder's campus with the greatest | ||
| enrollment is located; and | ||
| (2) the adjustment under Section 42.103 is based on | ||
| the lesser of: | ||
| (A) the average adjustment for the state that | ||
| would have been provided under that section as it existed on January | ||
| 1, 2018; or | ||
| (B) the adjustment for the school district within | ||
| whose boundaries the charter holder's campus with the greatest | ||
| enrollment is located. | ||
| (a-2) In addition to the funding provided by Subsection (a), | ||
| a charter holder is entitled to receive for the open-enrollment | ||
| charter school enrichment funding under Section 42.302 based on the | ||
| lesser of: | ||
| (1) the state average tax effort; or | ||
| (2) the tax effort of the school district within whose | ||
| boundaries the charter holder's campus with the greatest enrollment | ||
| is located. | ||
| SECTION 2. This Act takes effect September 1, 2019. | ||
