relating to funding for open-enrollment charter schools. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Sections 12.106(a-1) and (a-2), Education Code, | ||
are amended to read as follows: | ||
(a-1) In determining funding for an open-enrollment charter | ||
school under Subsection (a): | ||
(1) adjustments under Sections 42.102, 42.104, and | ||
42.105 are based on the lesser of: | ||
(A) the average adjustment for the state; or | ||
(B) the adjustment for the school district within | ||
whose boundaries the charter holder's campus with the greatest | ||
enrollment is located; and | ||
(2) the adjustment under Section 42.103 is based on | ||
the lesser of: | ||
(A) the average adjustment for the state that | ||
would have been provided under that section as it existed on January | ||
1, 2018; or | ||
(B) the adjustment for the school district within | ||
whose boundaries the charter holder's campus with the greatest | ||
enrollment is located. | ||
(a-2) In addition to the funding provided by Subsection (a), | ||
a charter holder is entitled to receive for the open-enrollment | ||
charter school enrichment funding under Section 42.302 based on the | ||
lesser of: | ||
(1) the state average tax effort; or | ||
(2) the tax effort of the school district within whose | ||
boundaries the charter holder's campus with the greatest enrollment | ||
is located. | ||
SECTION 2. This Act takes effect September 1, 2019. |
