disaster or state of emergency. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 382.018, Health and Safety Code, is | ||
amended by adding Subsection (h) to read as follows: | ||
(h) The commission may not require notification to or | ||
authorization from a commission regional office as a prerequisite | ||
for conducting a controlled outdoor burn of combustible plant | ||
growth in a county in which a state of disaster or state of | ||
emergency has been declared by the governor or the president of the | ||
United States, unless the declaration expressly prohibits all | ||
outdoor burning. | ||
SECTION 2. This Act takes effect September 1, 2025. |
