relating to the sealing of applications and orders for the | ||
installation and use of mobile tracking devices in certain law | ||
enforcement investigations. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 14, Article 18.21, Code of Criminal | ||
Procedure, is amended by adding Subsection (e-1) to read as | ||
follows: | ||
(e-1) The district judge shall seal any documents submitted | ||
to the court under this section, and any order or extension of an | ||
order issued under this section, until the period authorized by the | ||
order and extension expires. | ||
SECTION 2. The change in law made by this Act applies only | ||
to an application for a mobile tracking device that is submitted on | ||
or after the effective date of this Act. An application for a mobile | ||
tracking device that is submitted before the effective date of this | ||
Act is governed by the law in effect on the date the application was | ||
submitted, and the former law is continued in effect for that | ||
purpose. | ||
SECTION 3. This Act takes effect September 1, 2013. |
