relating to the training for and use of electromagnetic pulse | ||
devices by peace officers and reserve law enforcement officers. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter F, Chapter 1701, Occupations Code, is | ||
amended by adding Section 1701.260 to read as follows: | ||
Sec. 1701.260. ELECTROMAGNETIC PULSE DEVICES; TRAINING. | ||
(a) In this section, "electromagnetic pulse device" means a | ||
portable device designed to generate a high amplitude electric | ||
field capable of disabling an electronic system without causing | ||
permanent damage to the system. | ||
(b) The commission by rule shall: | ||
(1) designate an electromagnetic pulse device to | ||
disable a motor vehicle if the commission determines the device is | ||
suitable for use by officers; and | ||
(2) establish a voluntary training program for | ||
officers licensed under this chapter that provides instruction in | ||
the use of the electromagnetic pulse devices determined suitable by | ||
the commission. | ||
(c) The commission shall administer the electromagnetic | ||
pulse device training program and shall issue a certificate of | ||
proficiency to each officer the commission determines has | ||
successfully completed the training program. | ||
(d) The commission may establish reasonable and necessary | ||
fees for the administration of this section. | ||
SECTION 2. This Act takes effect September 1, 2011. |
